To be a bit off about M&S taking back my free dress?

I bought several items in the M&S sale. Couple of things didn't fit stupid sizing so I returned them for a refund. The sales assistant couldn't find one item on my receipt and said I could only have a credit note. I knew it was the correct receipt and I wanted a refund so she took me to customer services. We went through each item on the receipt to try and identify which one it was as it was just not scanning as any of the receipt items. Turns out I hadn't paid for it Shock. I had had no idea when i bought it as i just threw the pile on the counter, and paid when asked. I hadn't counted what was scanned or checked my receipt. Who does! It seemed that the original sales assistant had missed scanning or charging for the item.

So, there we were at the customer services desk, with me trying to return a dress I had never paid for, though i hadn't known that at the time. The sales assistant said they had to keep the dress and there would be no refund or exchange and they would out it back out for sale. I accepted that I should no longer be asking for a refund because it wouldn't be right since I hadn't paid for it in the first place. I did ask him if he could at least put the dress in the Oxfam box by the desk (M&S have a charity clothing collection scheme). Since the shop had already lost the dress through its own incompetence so it didnt seem right that it should profit from me bringing it back. He said he would ask his manager but I knew he wouldn't and it was a fob off.

I left the store feeling a bit off. If I hadn't brought it back then i could have ebayed it or given it to charity shop or waited til i slimmed into it. I lost myself a free dress!!! Ok ok I know that would be wrong and I'm honest as the day.

Has anyone else had this happen to them or have got unexpected free stuff?? Cheer me up!! and share some of your windfall with me

No they did NOT give you the dress.

So they kept MY dress! That's the legal position I think but of course I did the right thing and left it there once I discovered this.

If you think they have broken the law, (by keeping YOUR DRESS!) why don't you REPORT IT TO THE POLICE.

Go on I DARE YOU.

Tell them this story and see if they will confirm that M & S are indeed thieving cunts, and you are the injured party because they took YOUR DRESS!

The point when I realised I was returning a dress that I hadn't been charged for would have been the point I'd have shut up and left the shop.

Oxfam box? I cringed reading that.

No they didn't. They kept a dress they had given to you in error. The mistake was spotted and rectified. It doesn't become YOUR dress just because you turn the caps lock on.

I'll be honest, if I'd got home and realised I hadn't been charged for an item I would have thought 'their mistake' and not taken it back. But if I'd tried to return it for a refund and realised I hadn't paid for it in the first place, I'd just be relieved they didn't think I'd stolen it.

You didn't pay for the dress. You didn't even want it when you got home. You've lost nothing. What's your problem here?

Next put in a beautiful baby's outfit in my shopping by mistake in the madness of the July sale. I took it straight back. That's what honest people do.

I once did myself out of a free bed! Whole saga involving problems ordering, then the bed being ordered twice, and then when I complained and they credited my account they actually did it twice. Then I called up to put in the formal complaint (as advised by their customer services) and someone checked the system for my details and realised I'd actually been credited twice! So up to that point I'd had a free bed!

Never have I regretted complaining about something quite so much Wink

Why on earth would they? It's saleable stock that had been given away in error. That error is now fixed.

If you are so aggrieved about Oxfam missing out on a donation, why don't you donate something else to them? (preferably something you actually paid for)

What exactly are you complaining about. That you didn't get a refund on something you hadn't paid for in the first place. Sigh. Give your own donation to Oxfam if you're not happy.

I wasn't asking for judgement but cheers to the Moral Beryls for preaching at me! Oh and the p.o. who called me a thief, really? I don't think so.

And the police? It would be a civil matter not a criminal one because there was no dishonesty, it was a genuine mistake. I was talking 'technically' about the legal ownership. Not morally. I felt morally they should put it in the charity box. I also do donate a lot of clothes to charity so have that covered, but thanks for the suggestion Hmm.

I'm loving all you righteous armchair pronouncers. Grin Feels like being on Jeremy Kyle! I presume none of you have EVER done anything wrong, so you can judge with impunity Confused.

And I'm not complaining. Just felt a bit funny about it.

I'm enjoying this thread. Please keep the stories coming about getting free stuff. I like a bit of big corporates giving back to the people. Even accidentally! I am in no way condoning dishonest behaviour though. For the record for those who are crucifying me! Grin

There's no such thing as big corporates giving back to the people - they simply factor this kind of shit into their overall pricing across the board so everyone pays just that little bit more.

They didn't "give" you a free dress as they never said you could have it any more than if a hanger with a item had got hooked onto your bag and you walked out with it.

If Moral Beryl accidentally walked out of your house with a possession of yours that you still wanted would you consider that you'd given it to her?

Exactly. It's very odd that they should take it off you. It's as likely that you bought it on a different receipt....

Thing is, these stores get so mucn shoplifting and so many chancers nicking stuff and taking it back (trying to get a refund!) so they don't trust anyone. Least of all someone trying to return something without a receipt!

Yes but if I walk into a shop with a dress to return and its not on the reciept because I bought it a different day, then if they take it off me it is the shop that is committing a theft! They have stolen my dress from me.

I can't see it happening, to be honest.
