Okay so I wasn't going to post until I'd had some kind of resolution. However, planning called today to ask if they could access my garden on Friday as they need to do some "further investigation" and have another planning official who will be there to oversee it??

They wouldn't tell me over the phone what it was about (it wasn't Nice Planning Lady, it was someone I hadn't spoken with before)

Thanks pp for the thread title - which coincidentally was very apt!

No sign of CFN/ builders etc.

There's now a sign up saying
NO ENTRY IN TO PRIVATE GARDEN
CONTACT SOLICITORS NAME if you require further information.

May I ask how large your garden is Whatty? For some reason I'm picturing it being about 8ft by 8ft which would make the door situ just ridiculous. The Holy Diagram doesn't have dimensions on it. I've checked. which is more than the CFN did

#Blackistheneworange, do you always read the Staffs motto as "The knot unties"? I grew up there and I was genuinely puzzled by it. Why was an untying knot a good thing (I was an enthusiastic but useless Brownie). It wasn't till I was about 12 that I realised it actually said UNITES.

Finally caught up! Been with you whatty from beginning but kept getting left behind by ridiculously having to go to work!

Need to add my flags, birthplace (Cheshire) and current homeland ( Isle of Man)

Whatty please make sure that you (and/or your solicitor) advises the Freehold owner and the Management Company of the damage to the structure of the building. The current owner will be unable to sell the property without the consent of the freehold owner so this will absolutely stop any sale taking place. They will also be hopping mad as the building structure actually belongs to them and not a leaseholder so it's their property that has been hacked about.

If the proposed buyer (if there is one) needs a mortgage then they will need a survey (which the bank will insist upon for a listed building). Which will again highlight the issue (surveyors always check building status and are ultra cautious about being sued for negligence).

Even if buying without a mortgage the local search done by any competent solicitor would have the notification about a breach of planning law in relation to CFN's property. So try not to worry about a possible sale going through.

One thing I've not seen mentioned by PP's is possible right to light being acquired by CFN. Not likely as they should be forced to reinstate but better safe than sorry. Would advise putting some sort of boarding in front of doors up to level of original window sill to prevent any possible argument that they should be allowed to keep doors rather than reinstate window and wall as they have acquired a right to light not previously enjoyed.

Also agree with PP's keep a record of all costs and expenses incurred in relation to this incursion into your life and personal space (time off taken, solicitors fees etc) you want to reclaim all costs (can do small claims court if necessary).

Couldn't sleep last night so spent my time making up my own contribution to the various songs and ditties re the situation. Done to the tune of " The Grand Old Duke of York".......... here we go!

Oh, the neighbours' CFB's,
