Neighbours car!!! - PLEASE HELP

not really AIBU but need advice please
My neighbour goes to work at 10pm each night and comes home at 4am. His car wakes me up at both times EVERY NIGHT. It sounds like it's going to explode - not well at all.
I mentioned this to a friend about 3 weeks ago and said how I think it doesn't sound fit for purpose. Friend told me about how you can check online for MOT etc - I did, and the car has no tax or MOT thus no insurance.
I reported this to 101 and the dvla and nothing has been done about it! Furthermore - this neighbour has 3 DC who he looks after at the weekend, and drives them about in said death-trap.
I called 101 again yesterday with my concerns and they said contact dvla, I called them again and they said they have a "process" and write to the person first, then if not heard back in 'X' amount of days they escalate it.
I don't understand how this can go ignored for so long - the MOT expired last AUGUST!!!
I am at my wits end with being woken up each morning at this time, and also majorly concerned this person is on the road in a dangerous vehicle.
A friend suggested I write on the car in permanent marker - "this car has no tax or MOT". The friend said it in jest, but maybe that would actually work?! Obviously I don't want to be done for criminal damage though but I really am at a loss and frankly pissed off with the police and dvla!
What can I do?!?!

Just had a call back from Officer Dibble!
Apparently they are aware of the car after my last call, but as it's parked in a gated carpark they can't do anything - even though he said they've had it flagged on camera!!!
I said well I still have major concerns about the safety of the car and his DC being in it. I was told that if I'm worried about it, when I see him leave I can call and say which Road he's driving on (but by the time aby traffic police arrive he'd be long gone and I don't know where he works).
So basically nothing is going to be done about it.
I don't understand why he admitted it had been seen on camera, yet nothing is going to be chased up! All seems very strange to me.

Name - does the driver leave for work at exactly the same time and do you know what days he works? if so, I would be tempted to ring the traffic police a few minutes before he leaves for work. Hopefully they would get him driving down the road or going to get in the car to leave. If this wasn't successful the first time, I would continue until they caught him.

I reported a car with no tax to the dvla. It took a while but they did come and clamp it eventually.

if it s not taxed the dvla mght think it is sorned...?? obviously not as he is using it so f you have reported it to dvla make sure they know the car is being used so not sorned

Wow, sorry your thread got argumentative, it's bad enough suffering sleep deprivation without being told off for checking up on whether he has insurance or having your description of the noise analysed.

Have you tried complaining to your council's environmental health department about the noise? Like the police I expect they're stretched but I'm sure it's against noise pollution rules. Have you got neighbours who are also affected? Perhaps you could all complain.

Saw a car clamped in posh north London street earlier today because it had no road tax. Fancy car, too. This doesn't help you much except they do seem to be on to it round there.

My friend's child was killed by an uninsured driver who had no tax and no mot. I wish someone had done something about him.

The offence is driving on public roads without correct or valid documentation, this is breaking the law. Next time you see him driving this vehicle dial 999 and report it, don't get into a long conversation about it. This is a police matter, if they fail to take action find out the the name of your local police commissioner and inform him or her who should then take the police to task.

Any insurance cover in place would be invalidated by the lack of Tax/MOT. A vehicle must be legal and roadworthy to be insured.

Have you tried filming him using the car and posting it on the Facebook page of the nearest police with a Facebook page? That'll certainly raise awareness of it.

My car is 18 years old and has been known to make quite a few noises, the engine used to rattle terribly, the sound got worse and worse until it sounded like metal bits flying around in their so I told DH to turn around (we had only just pulled out into the road) turned out to be a bearing on the water pump making all the noise anyway water pump was fixed and car didn't sound so bad after that. It's still a bit rattly and noisy and the brakes squeak but it passed an MOT first time from a reputable garage that me, my parents and even my nan have been using for years. (I was shocked it passed straight away I was dreading the bill).

It's extremely worrying that he's driving around with no tax, MOT or insurance. There are things that happen if you get hit be an uninsured driver and usually you won't have to cover it or have your claims affected though not always. However statistically people who don't care about having those things also don't seem to be as careful on the road so that makes them more dangerous.

Not that the insurance MOT debate really matters. It CAN void your insurance but that doesn't mean it WILL. You can insure a SORN car with no MOT. If someone were to steal it or whatever it's still insured. Insurance is more often invalidated when the driver is knowingly breaking the law when the incident occurs. So drink driving, driving without Tax MOT on a public road etc. CAN invalidate insurance but simply owning a car without mot doesn't automatically void insurance at all.

Contact your council about noise pollution they will set up recording equipment and if the car shows as a problem they will have to take measures. We did this for a dog kennel at the back of our house and they ended up having to shut down and move as they couldn't reduce the noise to a level that was acceptable

THis has been covered several times on this thread and many others. Tax are MOT are not indicators of roadworthiness.

Please do try and find some proof otherwise though. Smile

Cars also don't need MOTs for the first 3 years after first registration. So your sentence is cobblers from that perspective too.

Tilly I take it your background in insurance was selling policies over the phone?

I have a law background and can assure you that if there's no Tax or Mot the driver is automatically charged with no insurance.

Unless of course you live out with the uk.
