Neighbours car!!! - PLEASE HELP

not really AIBU but need advice please
My neighbour goes to work at 10pm each night and comes home at 4am. His car wakes me up at both times EVERY NIGHT. It sounds like it's going to explode - not well at all.
I mentioned this to a friend about 3 weeks ago and said how I think it doesn't sound fit for purpose. Friend told me about how you can check online for MOT etc - I did, and the car has no tax or MOT thus no insurance.
I reported this to 101 and the dvla and nothing has been done about it! Furthermore - this neighbour has 3 DC who he looks after at the weekend, and drives them about in said death-trap.
I called 101 again yesterday with my concerns and they said contact dvla, I called them again and they said they have a "process" and write to the person first, then if not heard back in 'X' amount of days they escalate it.
I don't understand how this can go ignored for so long - the MOT expired last AUGUST!!!
I am at my wits end with being woken up each morning at this time, and also majorly concerned this person is on the road in a dangerous vehicle.
A friend suggested I write on the car in permanent marker - "this car has no tax or MOT". The friend said it in jest, but maybe that would actually work?! Obviously I don't want to be done for criminal damage though but I really am at a loss and frankly pissed off with the police and dvla!
What can I do?!?!

@tittygolightly Whilst I agree about the bulb going scenario, if we didn't have annual MOT there would be no checks for exhaust fumes, bulb alignment etc. Whilst only confirmation that the car was roadworthy at that particular time, it is still better than nothing.

And the police can stop you for bulb out.

It does irritate me when I spend money and time maintaining and insuring our cars that some people can just not bother and seem to get away with it (and it is true, no MOT or Tax does not invalidate insurance, especially not the TP element).

Tidy it can be classed as abandoned as it isn't taxed nor does it have an MOT.

its about getting the Police out.

Given the pressure the police are increasingly under, if much rather they weren't conned into attending situations such as this.

Titty - it was the 101 operator who told me the insurance would be invalidated. Although I would be surprised if he's bothered to insure it, given he hasn't taxed or MOT'd it in nearly a year. Also - it really is a death trap - trust me.

OP, if you are single, I recommend using background noise to mask the car instead of ear plugs. I was a shift worker for years so had to try to sleep during the day. I always slept with the radio on - more effective than ear plugs. You don't need it very loud.

Underhand, yes - but if you want a result, you have to use whatever strategy you can. If he can drive around with no MOT as fair game, then you too are fair game to get him nabbed.

Police will deal if they stop it on the road. However if parked up he could say he is not using it and they can do nothing. So if going to dial 101 give the times he drives though would be better to pass to your neighbourhood police officers. Don't know where you are but London most officers are ted up with all the incidents lately adding additional reassurance and security and dealing with life or death. While annoying there is just no one to deal and that is with most of them having their rest days cancelled and working long shifts

Round my way, the police will only really do anything about nuisance driving if there are lots of reports about the same car. It's easy here though, you can report online, so not hard to get all your mates to do it.

Fancy but he's NOT drinking and driving and the op doesn't suspect that's happening. You can't make any old malicious allegation against someone just to get the police to come out. They've got other stuff to do!

Anyway, it's the OP's choice as to what method she employs to deal with it. I'm sure the Police come across a lot of malicious reports etc on a daily basis - and sometimes it takes a malicious report to catch someone out - like those that flout the MOT or drink drive rules.

Yes, lying to the police is always such a great idea!

OP you've informed the places that need to be informed and their process has been started. That is all you can do. Unless you want to start lying and wasting police time of course.

Perhaps you need to try and re-read what others have written.

You said to tell them he has been drink driving, others have said you can't do that because he hasn't been drink driving. Quite simple really.

Someone driving their car at 10pm and 4am to go to and from work is hardly anti social or illegal.

It's unlucky you are woken by it, but that's just unfortunate for you if you live in a built up area

I think YABU. You've done all you can, now let it go.

You can check yourself if he is insured on the askMID website. There is a link to it from the website where you check if he has tax and MOT. or use Google Grin

I'm surprised he hasn't been pulled over for not being insured already. Mind you, he could have insured it shortly before the tax and MOT expired, so it wouldn't flag up as uninsured unless the police checked his details fully.

Round here the police have a couple of days every six months or so where they park by every entrance and exit to the town. Their ANPR cameras check every vehicle that goes past, and they pull over loads of people each time! If they do this near you, he'll be caught eventually. In the meantime it may be tricky as they'll have to catch him in the act. Police are so stretched they can't just hang around just in case he drives past. The DVLA will fine him for having no Tax if he hasn't SORNED it though. Keep reporting and pushing, he won't get away with it for much longer.

You could try calling the council for 'noise abatement' in that the car is unduly noisy.
