She cashed both fucking cheques!!

Sent somebody a cheque for their birthday. They 'lost it' and asked me to send another. Prehaps I was foolish to do so, but I did. Now, both cheques have come out of my fucking bank account!!!!

Oh I missed crossing out the name, I thought you meant mistakes with the date or whatever. Then you initial the mistake.

Can you contact your bank and see if they both went into the same account - if not, tell the bank it was lost and the intended recipient didn't cash it - I would tell that relative too that you are doing so because if they have cashed both they may need to admit it first or look really stupid

you really think someone is going to open a false bank account for the sake of a 25 pound cheque?

Unlikely but you never know - eg. if the person has the opportunity to intercept mail (eg. in a shared building or an employee - which was the lawyers case).

But if you can read, you can see that was only one example in a list - so yes I do think you are naive if you think it is impossible to cash a cheque not made out to you. Cashiers do make mistakes/don't notice errors especially at busy times and plenty of people will have a go.

Your statement was a very dogmatic nobody else can 'cash a cheque' that is made out to somebody else. It is simply not possible. Simply not possible? Yes. Naive.

It wouldn't matter whether cheque was crossed if relative was going to cash both.

Were they both put into the bank at the same time, or several weeks apart?

Thank you for all the replies. I've just checked, they were cashed at the same time. I've tried to phone up to politely ask if there was a mistake, but she didn't answer and it went to answerphone.

Could this be someone prone to being a bit ditzy who had put the first one in their bag (maybe alongside other cheques to go to the bank with) and forgot about it and then received second one and paid in a few cheques into account at the same time not realising? Just trying to think of all angles, although I think this is being a little generous Hmm

I'm just amazed that the relative asked for a replacement cheque.
I've not cashed cheques in time on more than one occasion (is it three months?) and had to write off the money (I'm talking £10 gifts). The sender has never asked me about it so I assume they don't check their statements too rigorously and I've always felt it's fine as they haven't lost the money, it just never went to me.

No, I haven't left a message as I'd prefer to have the conversation on the phone properly if you see what I mean? To the poster who said I'm quick to jump to conclusions, I don't really think that anyone would steal a £25 cheque. She has a rather long, unusual surname too, which couldn't easily be changed. Whether or not intentional, it does seem like she cashed them both. If I haven't been able to get hold of her by tomorrow, I'll probably leave a message. If it was an accident, then could I just say she can keep the second one as an Xmas present?

OurBlanche, that section of the law relates to endorsing the cheque, not to making amendments to it.

Choccy it's six months - although technically cheques are valid for six years, but after six months the bank will either ask permission from the other account owner to cash it, or ask you to get a newer cheque.

Why don't you just phone up "I see the missing cheque turned up after all, aw well that save's me buying you the Christmas Present I had in mind for you - chuckle/giggle/light hearted"

It's going to be silly to try and get the money back and if you were going to buy her a present then it's just as easy to do that - I certainly wouldn't ask her if that's an okay option!

Hope it gets sorted op. It's horrible to think a relative would do this deliberately so hopefully it was an oversight (tbh, I doubt it though)

As a side note, my bank doesn't charge to cancel cheques if you report it as lost. My son's sports club destroyed my cheque (long story) and I had to write a new one. I explained this to the nice young man on the phone and he kept trying to get me to say the word "lost" otherwise I would I could have been charged £5 to cancel. Always worth asking!

How does that work? The cheque is made out to MsRelyofFingPissedOff so it can only be redeemed into the account of that named person, as written on the cheque.

Mine just gives the cheque number and amount, not the payee.
