Hundreds of thousands of people were willing Condemn a innocent man. He was practically forced out of football. This is why we can't play jury from our sofas.

Is that allowed? What do you think?
It's outrageous that the jury wasn't told that Evans' girlfriend tried to 'incentivise' the receptionist and I don't think many people are convinced that the two new 'witnesses' didn't um have their heads turned either.

I go back to the prostitute analogy.

If a woman accepts money for sex every night, then on the seventh night she's raped, but the rapist claims he paid her, you can't say "oh well she took money for sex on Monday, Tues & Wed. Even if all of that sex was in a particular position in a car.

No one claims that because she liked sex she had a right to be raped. That is the prostitute analogy.

No the prostitute analogy is that the prostitute has done the same thing 5 nights a week, if on the 6th she's raped but the rapist says he paid her, well, it's not a great defence.

I think the defence that the Ched Evans girl had had similar sex to what Ched described is a poor defence.

Are you sure the bung was not mentioned? I read a report that the prosecution were allowed to mention it as a condition for allowing the witness testimony in.

If I'm a woman living alone and I invite a male friend to stay, then he comes from the spare room ties me up and rapes me. Is it a good defence for my exes to say I like to be handcuffed?

If he raped me anally is it a defence for my exes to say I loved anal?

If assaulted me orally s it a defence for my exes to say I liked oral sex?

Sorry to be graphic and not real scenarios but why I think sexual history is a poor defence.

Portia, they were allowed to ask the witnesses whether they were motivated by the £50k. One of them said he didn't know about it until a couple of days earlier (yea right).

They were not allowed, however, to press the point about witnesses being contacted individually and being pressed to give information, which the prosecution suggested had "the flavour of a bribe". The prosecution were not allowed to pursue this line of questioning, as far as I can see.

No it was specifically disallowed because the judge said masseys behaviour didn't have the flavour of a bribe.
More than the coaching is also the fact that it was reported in the previous trial that the victim said fuck me harder to mcdonald. So the new witnesses could have read that (or been told that) rather than plucked it out of thin air.
Given the limited conditions for sec 41 to admit sexual history and trigger a retrial it's all rather convenient.

I think that ordinarily this case wouldn't have even got to court, I think the reason they were able to convict him was because of his predatory behaviour, sneaking in and out of the room, admitting he didn't speak to her, he didn't have reason to believe she consented, that's why he was found guilty and not his mate.

I do t think he should have been allowed a retrial because the 'new evidence' was shoddy and they bribed the witnesses.

There you go, so sue me Ched.

I think it is more like (to use the famous cup of tea analogy)!a stranger coming into your house and (without speaking) offering you tea. He then leaves without you ever speaking again.

He maintains later that, as you were drinking the tea, you said 'fantastic tea, earl grey, make me another cup'. Later two more people who have made you tea remember you using exactly those words as you enjoyed your tea.

I am not saying that is what happened, as I have no idea, but that was his defence. I assume the prosecution did say that this was a common phrase used while enjoying tea.

I am really curious what the judge told the jury as she sent them out, in detail. I do know (from sky news) that she said it was not about his or her morality.

No the prosecution didn't say that larry nor did they say the phrase had been reported at the other trial. No idea why.
They also didn't being in mcdonald saying the victim was "sick" when he left the room (ie while ched was doing sex to her).
They did say that evans had offered 50k for info on his website but not that Massey had actively been contacting witnesses.
The whole thing absolutely stinks.

No foubt the transcript will be online somewhere but I have never bedn to the police because I was too scared of going to court.
Meanwhile the person that punched me to the ground and broke my arm and raped me has a happy life

I apologise if it is as I am not a lawyer. It read to me,though, that it was addressing both sides of the argument and certainly quoting relevant law to support its arguments.

There are some proper barristers on here, though, so I would like to see what they make of it.
