I'd be pretty pissed off too as it sounds both stupid and dangerous. Add to the fact it doesn't seem necessary considering your garden length then its inconsiderate too.
Pop round and try to explain to him but don't smash any faces in just maybe some hard stares and a few choice words. he may not have realised, people are quite blinkered where their boundaries end.
We live ground floor apartments and everyone congregates there for their ciggies, right outside my open lounge window (not theirs) drives me batty until I pop my head out and remind them.

EatShitDerek Thank you! My beloved dog is sat on my feet preventing any smashing of faces. Have sent yet another email to the council . It's just awful to live next to people who lack consideration. He could have just lit it at the bottom of his garden or even waited until kids at school. It has been such a long week with exams and DD having disturbed sleep.

YANBU. If you had said you were going to smash his face in, you would have been. You can want to all you like. But as I have reminded my DD multiple times today, you can't always get what you want.
