To be pissed off at having just seen my tenants spending a load of cash whilst they're behind on rent?

I am fed up to the back teeth.

This is the third month now where they're falling behind.

(I know them by their appearance and we have a mutual friend on a social networking site)

I have just seen them paying for a spa and no doubt it'll be up on social media next week (they like to brag and display all their newly acquired gains in Instagrammed glory.)

Next month my kids won't have the birthday parties they wanted because I'm subsidising these idiots living expenses and incurring charges as for their late/part payments. Angry

Has anyone managed to get tenants out despite then not being 2 months late on rent. The Lettings agency have told me I'm stuck with them . Can I fine them?

They got a 12 fixed contract in January and surprise-surprise they started to default from day one of it.

I'm so upset.

I actually think that (compared to other businesses / business owners), landlords gets an inordinate amount of flak (on MN and elsewhere), and that this may contribute to a minority of tenants not paying rent in order to "sock it to the man" rather than treat their obligations to pay rent / take care of the property they way they may treat other obligations.

Totally agree Essential. I do think SOME of it comes from jealousy or a feeling of bitterness that maybe they can't afford to buy. That is absolutely not all tenants by the way before I get slaughtered!

Haven't had a chance to read fully so apologies if someone has answered this but is there something in your contract that stipulates that the rent must always be paid within 14 days of the date that it's due? I always write that into my tenants contract to avoid this sort of BS. If the agent has put something like that in then they are in clear breach of the contract. I wish you the best of luck OP x"


Hands off you refer to your experience and knowledge frequently on this thread so I dot understand your advice. What does the above referenced clause give you? You can still only evict for reasons set out in statutory law.

Sorry Buckin I realise I may have not been clear there. I should have stipulated that the clause re late payment I insert this:

7.6

The landlord is entitled to terminate this tenancy agreement and obtain a court order to evict the tenant if:

A) any instalment of the rent is not received in full within 14 days of the date when it has fallen due etc etc

Sorry was wrestling a baby at the time!

If it's in the contract that's another S.8 discretionary ground for eviction (12?). (I'm not sure if that's what she was getting at, but that's how I interpreted it.)

Somebody along the way said you can't defend a S21. A tenant absolutely can if it has not been done properly. I would strongly suggest making sure you know exactly how a S21 should be properly served because it will take months to evict and cost a lot of money if it's done wrong and goes through the court. A judge can throw it out and you are back to square one. Don't trust the LA to get it right.

We have a clause in our rental agreement that if a tenant is 4+ days late in paying then they incur interest by the day. We have never actually used this clause, as the tenants we have come and talk to us if they're having problems paying and we sort things out, but if we had your tenants we'd be putting notes through their door every day saying how much they owe now, and now, and now Grin

Jesus Christ, this has turned in to a vile thread. LOVE the implication that if you are a late-paying tenant with a penchant for luxury goods, you are just a stand-up citizen. But a landlord who expects to be paid rent owed - what an absolute lowlife.

hands - how does that work in practice? (I'm not being goady, I'm interested for the obvious reason!) As in, that clause presumably wouldn't shorter the timeframe of an S.21, and under S.8 it doesn't seem to go to a particular ground any more than "just" rent arrears. How does it work? Does it have the effect of ending the contract (and fixed term) so you can then use S.21?

I'm a LL and a solicitor and I am baffled by the mechanics of this.

That's ok Essential I appreciate you're not being goady. In all honesty when I wrote the newest set of contacts (that's one of them) I sought legal advice from a solicitor who agreed all T&Cs in the contract. Since then as I've said we've had to use that clause twice and it's been good enough grounds for eviction. I will dig out the paperwork/letters etc relating to both cases and get back to you if that's ok?

Essential and Hands - there are a hell of a lot of cynical, unpleasant landlords around. They come in all shapes and sizes. Obviously ALL Mumsnet landlords are caring, reasonable people with superb business sense and the utmost compassion for their tenants.

Then there's a million others, who don't post here Grin A high proportion of them are nasty bastards.
