A parking one!

We have put in a new driveway and the council have dropped the kerb outside. However, they have failed to remove the markings that there used to be a parking space there. The markings are a bit of a mess as the old markings are there alongside the guides the council have put there to show where they are moving the parking space to.

A young girl has come along, parked her car, put her headphones in and walked off in the direction of the town centre. I didn't have time to run out and stop her and the headphones meant shouting after her wouldn't have done any good.

Would I be unreasonable to request that the council send a warden out to give her a ticket?

There is no way that she could have missed that she was parking across our drive. It's large and has a big car parked on it. There were 2 parking spaces there and our drive is bang in the middle... she has parked her small Fiesta in the middle too. So right over the dropped kerb with no attempt to leave any room for access. Had it still been a parking space she would be effectively stopping another car from being able to park there. If she had parked at the beginning or end of the bay we could have still got off our driveway.

So What would you do?

It isn't illegal if there is a parking bay marked on the road irrespective of whether there is a dropped kerb or not. I am not being naggy just pointing out it isn't illegal but hey ho if you want to turn a blind eye to that to suit your justification go for it.

BUT SHE WASN'T PARKED IN A LEGALLY MARKED BAY.

The OP says she was parked across two former bays, so not in one or the other.
She was ticketed, so something wasn't right was it.

Maybe the permit was her dad's
Oh, maybe yes.
Our permits have to have your registration plate and details on them but I suppose her father could use her plate and his address for her.

I am not the girl or her mother so stop attacking me I am allowed to post my thoughts so no need to tell me to shut up or swear at me either. OP's personal situation is her own she didn't have to tell anyone and I for one didn't ask her to because it has no bearing on the parking issue whatsoever.

Of course anyone parking on your drive is being illegal but a parking bay marked on the road outside a dropped kerb doesn't make it illegal to park there.

So what was the ticket given for...certainly not because its due to a dropped kerb since tickets can only be issued for the following reasons:

on yellow lines
in a permit-only zone without a clearly displayed valid permit
in a council-owned car park or on a metered space if you haven’t paid the parking charge
in a car park or on a metered space if you haven’t paid the correct amount for the time you've been parked there, or haven't clearly displayed the parking ticket
anywhere else where parking is banned, for example, on white zig-zag lines or on the pavement.

Considering it isn't yet banned to park infront of the dropped kerb as there are parking bay markings there it couldn't be for that reason.

I am not attacking OP but I am allowed my opinion to say its just an OTT reaction for what is a one day one off incident.

I wouldn't have a problem calling it out in real life either. I am allowed an opinion and can voice it whether its on the internet or in person. OP asked if she BU and I stated my opinion I haven't attacked anyone directly here, swore at them at all unlike many others who have to me so maybe some of those who have should look at their own behaviour instead.

No I wouldn't mind at all go for it if you need to park there, it wouldn't affect my daily activities at all considering I am fortunate enough to live within walking distance of a train station and even if I did need to get off my drive I can just check in my neighbour who would have no problem in me driving onto his empty driveway to get onto the road.

In my Borough someone can legally park in a permit bay during controlled hours , on/across a dropped kerb if they are displaying a valid permit. The vehicle would only be issued with a PCN if there was a compliant from the house owner.

Many Boroughs in London have this system in place and will only enforce on receipt of complaint. This means that your friends/partner etc can park across the drive with your permission and not receive a PCN.

Not saying I agree one way or the other, merely stating the way it is for some/many London areas.

Malia my neighbours in a London borough got a ticket for parking over there own dropped curb. No one complained.

In London whether you get a ticket or not for being parked over a droops kerb used to vary by borough; in Bexley you'll get a ticket, in Lewisham not. Have vague recollection of that possibly being changed but don't know if it did or not

So, just because you can drive down your neighbour's drive, if someone parks across your drive, the OP should not get cross or do anything when she is blocked in on her drive, and can only get out by driving down the pavement? That is utterly incomprehensible, LilMissSunshine.

She copulent afford taxis to and from nursery, has no local friend, neighbour or relative who could have gone to collect her child from nursery for her, and does not feel well enough to walk there and back (due to genuine health conditions).

What do you think she should have done in her precise circumstances? Wait until the girl finishes work, and maybe be too late to pick her child up from nursery? Pay money she doesn't have for a taxi? Drive down the pavement and risk hitting a pedestrian?

I think you are being incredibly unreasonable. Unlike the OP, who had every right to do what she did.

It's also clear that the parking enforcement officer believed the car was parked illegally - because they issued a ticket. It seems fair to assume that they know more about this situation than you do - what with actually being there and not judging from behind an a computer screen - from which you cannot see the OP's drive!

Alice sorry about your neighbours. My example specifically related to permit bays with dropped kerbs within them.

As someone else pointed out, not all Boroughs adopt the same policy.
