to tell my landlord that I would look into paying the rent and get back to them?

and then not.

and then when they phoned again, tell them that I was going to write a cheque and I'd probably post it within the next week.

And then when they phoned again, tell them that my husband dealt with cheques, but only monday -wednesday, so he'd have to do it next week

And then when they phoned again - and by this time three weeks have gone past - tell them that I am going to write a cheque, but it won't be till next week and then it will take a week to get posted.

??

What? Not reasonable, you say?

Then WHY DOES MY LANDLORD THINK IT'S REASONABLE TO HOLD ONTO £500 OVERPAYMENT FROM ME?!!!!!!

I just do think that once they have said to me they would refund me, that they should do that. If, otoh, they had said that they wouldn't, but once it was sorted, then they'd reduce my rent payments until the credit was used up, then fair enough.

See, I just can't accept that I could possibly be wrong, can I? Blush Stubborn old cow that I am Grin

Yeah, I know. Ignore that. That's my own feelings of inadequacy coming through. It's pretty shit to be in a position where you need help, and then to be begging for your money back in the way that they've promised they would give it back makes you feel about 2 inches tall.

You're not begging though.
If the person who owns the house is overpaid, he is overpaid. Whether ' he ' is a private landlord, mortgage company or HA.
Few of us own our homes. The bank owns ours. If DH or I lost our jobs we would have to claim HB.
Doesn't make you scum.

I applaud your acceptance that if you post "Am I being unreasonable to do X?" then reveal that it's someone else who has done X, a good proportion of people will get confused. :)

I do think your landlord is being unreasonable and should have sent you £500 when he received £500 from the HB people

I also think you would have got a much better ratio of advice:arguments if you'd posted in Property or Legal with a title like "overpaid rent and housing benefit". (less exciting but potentially more useful)

I understand that stealth but the reality is that her money was paid to the rent during the back dated period, therefore the £500 is the LAs as it has been paid to the housing association and Ops has been absorbed as rent.

True. I did. I wanted a great big attention seeking whiney whingemoan.Blush And I thought - wrongly I accept - that my OP was clear. And I've already apologised for that.

I've done all I can do. Wheels are in motion. There's nothing more I can do. The cheque is in the system. Going through their procedures and will be posted to me next week. Probably Grin. I was just whinging that it's taken a good three weeks to get to the point where there's an unsigned cheque with the finance department that will be signed next week and posted by friday.

it is annoying I have the same with Student finance about child care, i have a whole year due to come, but there is no sign of it yet let alone a cheque in the system, i just need to be patient.

If you want to continue the whinge - why is it a cheque anyway? Can't they just put the money into your bank account? What's with the insistence on using little bits of paper - they could do it instantly using the magic of computers.

I said well, you can. The technology exists to allow payments to be made from one bank account to another, so it is not that you can't, it's that you won't.

Which went down like shit on your pillow and is probably the reason they've stuck the cheque in a drawer for 3 weeks Blush

What I hate is the fact that if it was the opposite way (IE as in your OP) no way would they accept it. Same with banks, they charge you and they take it instantly, but if they owe you, suddenly there is 10miles of paperwork to get through.
