To ask neighbours to stop smoking right under my flippin window

I live in a flat and just had very young neighbours move in with a very young baby all they seem to do is puff away on fags all day im the first floor and they are underneath me and today suns out and they are standing directly under my window chuffing away making my home reek. They smoke in their home which isnt illegal but this also makes my flat reek. It drifts everywhere.

Im not against smoking and am partial to one from time to time but wouldn't stand right under someones window and smoke If I ever have one I go away from peoples windows. It just seem so bloody inconsiderate. Im going to ring my HA but this girl is really starting to piss me off already ive gone from having a right misrable old git living below me and I couldn't even fart with out him moaning at me now I have inconsiderate numpties living below. I was really hoping for nice neighbours I think I deserve it after the weirdow I had living below and Ive gone from bad to worse. Be careful what you wish for I guess! I know people put up with worse I fear it is going to get worse though :-(

Apart from the smoking, which you yourself do, in what other ways are they not nice neighbours?

YANBU to ask them to smoke elsewhere, I'd say, but be reasonable and calm about it, not confrontational. If they are unhelpful then ring the HA.

I think you need to take a deep breath and then approach them politely. If you go down there ranting and raving like you are on here, they are going to think you are the neighbour from hell, and hardly likely to want to be considerate.

They prob haven't even realised that the smoke is going through your windows. Otherwise, close the window they are smoking under and open windows on the other side of your flat.

This happened to my friend, she used to go stand outside her door whilst having a fag (ground floor) until the neighbour above came down and politely told her it was going through their window.

My friend was very apologetic as she had no idea and smoked somewhere else. I would politely ask them first before ring your HA

Hairy I had a very brief convo with said person & she told me she was a single mum but ever since she has been here her partner and father of her child has been living here which makes me think they are fraudulently claiming.

Me and DP are struggling as much as the next person with commuting, kids, rent rises etc etc and its wound me up tbh I am very upset as I feel she has insulted my intelligence and is being dishonest.

I also asked the HA to clear loads of rubbish left by previous tennant which was left down the side of our property and they wrote to inform us what date this would be done. I would of done it myself but there is ALOT and I only have a small car. So she dumps her tv unit down there for them to take. I always go to the tip and take my large items. & wouldn't expect the HA to clear up after me

Its so sad that so many people are filty pigs. I really try not to be a hellish moaning neighbour but I feel one is going that way :-(

So apart from you thinking she is fraudulently claiming and her sticking a TV unit with some other rubbish that is being cleared anyway she hasnt done that much wrong up to now?

It would at least lodge something against them to put on record - so if it continued the HA might be able to evict?

I know when I was living in a shared house, we all had problems with one fella in particular, but never mentioned it to LL as it seemed too petty. When he left, we mentioned it, and she said "why didn't you tell me earlier, I could have booted him out!" and had been looking for a reason to get rid anyway.

So, you never know.

I doubt they would / could evict if the smoking outside is the only complaint, its not illegal is it?

Its not illegal to smoke outside, However it is illegal to smoke in communal areas our hall stinks inside our property and our communal halls stink. Its just about the consideration and thinking of others. People do worse & smoking isnt a crime. The HA wouldn't evict someone for smoking, you have to do some pretty bad stuff to get evicted.

I just always try and be considerate and think of others & perhaps I expect the same from people. Maybe im just highly strung???

Im a very occasional smoker, and I'll be honest unless its my cig I can smell I dont find it particularly pleasant, but I think it would be a bit hypocritical if I ever complained about the smell of smoke.

They are outside their own home, there isnt much you can do except just ask them to maybe move a bit further away.

I used to smoke and when you are a smoker sometimes you just don't realise how much it can affect others. She probably hasn't thought it will be affecting you, just ask her nicely to stand a bit further away from your window!

I think maybe you have had shitty neighbours before and are expecting the worst from these ones too. Putting her tv unit out to get cleared away seems quite reasonable to me, it won't have made any difference to the HA. As for the suspected benefit fraud, you don't know anything for a fact, and if she has her boyfriend staying is it really any of your business?

Stop looking for things to get annoyed about, ask her about the smoking thing. I'll bet she'll apologise and move along a little. You're getting your knickers in a twist about nothing IMO.

Can I ditto Nightowlmostly's post? Makes sense to me, just point out, nicely, that the smoke is coming through your window and ask if it would make any difference to them moving 6 foot along the wall. If she refuses, you could possibly purchase a cheap window box which would deflect the smoke. The HA won't do anything as she is outside, and if she has a yung child then so she should be. I don't think you are being unreasonable for wanting her to stop, but YARBU if you don't tell her - she's not a mind reader.

YANBU - I smoke outside sometimes and I'm aware my upstairs neighbour has her bedroom window open so I don't smoke anywhere near it.

MY dh has his friends come over they nip out for a fag and I tell them to stay away from that's neighbours window if it's open.

Common sense.

But you need to tell them - they probably just don't realise.
