To think this is the lowest of the low and worry why my neighbours did this

my next door neighbours were banging on the wall this morning in the living room because they were pissed off at my 10 month old crying (she is ill). Just as background.

Anyway my 4 year old was playing outside and managed to get his head totally stuck in the swing, cue us spending a wonderful 15 minutes with soap and finally having to cut the middle of the swing to get him out.

And there's my neighbour hanging out her upstairs window filming us on a camera phone?!

Wtf?

You'd better check youtube. I'm not sure where you stand if she puts it on there though. What weird behaviour!

She's going to put you on You Tube.

But I don't think she can film you or your children without your permission.

Report her to anyone (police, council whatever).

And spread it about to all the neighbours that she secretly films kids on her phone.

Perhaps not that last bit. I've just had a bit of an unnerving drive home where an idiot tried to force me off the road. I'm feeling mean.

Oh and you can report her for banging on the wall too.

It doesn't matter if your baby screams all night long, the police and the council do not call a crying baby a nuisence, but they do cound idiots banging on walls because of it as a nuisence.

I'm not sure, but i think you can film/take pictures of people without their permission. I think the only UK legislation to stop you is counter-terrorism (which probably doesn't apply to swing/head situation!).

Not saying it's right by the way - she sounds a fecking awful neighbour, and YADNBU - but not sure there is legal redress?

Happy to be corrected though!

Are you 100% sure she was filming you?

She could just have been watching what was going on whilst texting or something.

Either way, it's a horrible thing to do.

She sounds awful! But unfortunately she can legally film you. People often think there is laws in place to stop people filming you or taking your picture, but there is not.

I'm sure there is some legality against filming people against their will?? Call the police non emergency line.

You cannot film other people's children - there IS law in place to stop that. Or every pervert would be doing it...

What an awful neighbour. Appalling.

There is no law stopping her from filming. This could be the start of harassment though.

Start keeping a record.
Could you go around to speak to her and explain that your child is ill and that you were doing your best?

I'm afraid there is - the child is on PRIVATE PROPERTY and under 16, which makes all the difference. If they also go on to make money from it such as YOU'VE BEEN FRAMED without permission of the parents - they violate another law....

They can film, but publishing the film they took on the internet would be a misuse of your DS's private information, as well as possibly the start of harassment. If it is posted, a complaint to the site should see it taken down.

Report it to the police and get a case number. The police might not do anymore, but then at least you have proof.

The filming isn't the issue -it may be harassment but the filming itself is not a criminal offence.

Why the hell didn't you shout at her from your garden and ask them what the hell they were doing? Nip things like this in the bud. Now go and knock on the bitch's door and ask her what she was filming.

When I was walking mt Year 6s through the city last year, a TV crew had to stop filming for a documentary as they were not allowed to film under 18s without parental permission.

I'm not sure, but maybe it's the case privately too?

That's because the film crew had a commercial interest and it was to be broadcast. Technically you can film in public places but with the fear about paedophilia - people will often report it.

You can take pictures of whomever you like ina public place unless they tell you yhey do not want to be photographed, what you do with the material though has other ramifications.
