I bought DS2 a nintendo DS lite before Christmas it was to be his main present. Mainly because he plays on my DSi and DS1's DSlite.

Anyway I found a bargain £45 including gaurenteed next day delivery.
It never arrived, I asked for days for the tracking number and eventually got it, I called RM on the 2nd January to be told the number was not only invalid but also non existant. I contacted the seller and told her this, she insisted RM were wrong.
I spoke to them again and apparently the first 2 letters of the tracking were from a previous month in 2010 not December. I once again contacted the seller who then apparently spoke to RM, who told her if it didn't arrive by last Friday it was officially classed as a missing parcel.

Well it never arrived. I informed her of this on Friday and apparently she refunded into my bank on Saturday.

Well the money is not there, I have contacted her via FB and everytime I send a chat message she logs off.

I am peed off because it was DS2's main present and I need the money to buy him another DSlite.

I have also spoken to my bank who confirm there is no payment made into it for the amount she owes me.

Was it eBay/paypal?you can raise a dispute and get a refund that way.... If not, perhaps contact trading standards...

egopostulosomnus · 12/01/2011 10:46

maybe try fb wall rather than chat? might shame her

TheLadyEvenstar · 12/01/2011 17:55

Sorry been out all day and just got back in.

It was via another parenting forum I bought it. I have already posted on FB wall asking her to contact me and thats when she said she had sent private messages - which oddly enough I did not recieve.

I am going to put another posting up. Because there is not anything else I can do.

She cannot pay into your bank if she does not have your account details.

If you paid via PayPal you should go to the original transaction and click on it, scroll down does it say refunded? It would only not be in your PayPal account if you funded via your debit/credit card then it goes back to the card.

If no refund has been processed file a claim for item not received via PayPal and escalate to a claim immediately.

FrequentNutter · 12/01/2011 18:00

If you did not pay via PayPal and she does not give you your money back you are fucked. There will be no way to get your money back unless you take her to court, and for that you would need her address.

I hope you paid for goods via PayPal.

Always use PayPal to pay for goods even if not purchased on eBay as you are protected against non receipt and not as described, sounds like you have been scammed.

TheLadyEvenstar · 12/01/2011 18:44

Well I posted a message on FB Wall and she appeared calling me an arsehole Hmm

I paid via bank transfer and have asked for her to refund either the same way or via PP.

OP posts:
FrequentNutter · 12/01/2011 18:44

She would need your bank details to pay you via Bank transfer they are not automatically shown when you make a payment, only your name would be shown.

pickgo · 12/01/2011 18:49

Summarise the history as you have on here.
Send it to her by private message.
Give her 5 days to respond with refund... tell her if she does not do so you will petition the small claims court and will have to refund your money AND compensate you.
Hope you've got her address though, you'll need it to go to Small Claims Court).

HelenaCC · 12/01/2011 19:04

Credit card or paypal are the only ways you should ever pay online. I'm sorry but there is no way to recoup monies paid by bank transfer. You are reliant on the goodwill of this woman (small claims too much of a pita). It's a harsh way to learn that lesson. I'm guessing she has pocketed your money :(

AnyFucker · 12/01/2011 19:06

what a bitch

sorry, TLES, sounds like you have been scammed

pigletmania · 12/01/2011 19:16

Sounds like you have been had. I think the best thing would be to buy off e bay, at least you have some comeback if things go wrong, they usually work in favour of the buyer.

badmummy101 · 13/01/2011 16:58

did you buy it from a person or a shop?
£45 would have been ringing bells for me.

ILoveItWhenYouCallMeBoo · 13/01/2011 17:02

shit, sounds like she's pulling a fast one. i have a feeling she will just block you from facebook if she doesn't want to repay you. find out as much info as you can off her FB profile and see if you can get her address. do you know the town she lives in? was she just another parent on a forum or is she a business?

NettleTea · 13/01/2011 18:48

can you contact the mod of the other forum? they might have contact details - hoping you have kept copies of all the correspondance....

TheLadyEvenstar · 13/01/2011 18:51

Does anyone know if ALL banks take 3 days to send money as a bank transfer?
She is trying to say it takes 5 days

OP posts:
TheLadyEvenstar · 13/01/2011 18:55

Should have said I have just got off phone from my bank and there is no evidence of the payment being made from herSad

OP posts:
TheLadyEvenstar · 13/01/2011 18:59

OP posts:
queenrollo · 13/01/2011 19:00

i transfer money into my dp's account and him into mine reguarly and a bank tranfer is instant.

i'm sorry but i'm inclined to go with the others opinion that she has scammed you.

badmummy101 · 13/01/2011 19:03

you have been done.
sorry, but ihave to ask. why did you send a woman you didnt know 45 quid? what prof did you have that this was legit?

TheMonster · 13/01/2011 19:06

Was it Bounty, TLES? I stopped using that site's buy and sell because of the amount of scammers and frankly rude cows there.

TheLadyEvenstar · 13/01/2011 19:44

Body, yes it was bounty.

I have bought of this woman in the past, thats why I did again.

OP posts:
TheMonster · 13/01/2011 19:45

Have you put up a thread there for her to respond to?

TheLadyEvenstar · 13/01/2011 19:51

I have messaged her privately on bounty and fb but she is adament she refunded me.
The bank say there is nothing from her.Sad
