to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

you can threaten and they will laugh about it as they will know you don't stand a chance of winning. it will not spur them into any action. far better to contact H&S and leave it at that. like normal people would do.

Nursie the op was given a simple Yes and refused to accept it. That is the sticking point.

But I have been where OP is and tried to do the H&S thing that has been suggested by her and to her but she won't blardy read that post and reply.

mumbar, I know they haven't checked this table or done a risk assessment, they dont care, as they like the design of the lounge.

even tho people are getting injured, from these tables.

Im sorry your son went through that, however its different that the theme park took action, this hotel just doesn't care.

i thought part of a design plan for places like that had to involve a risk assesment?

Mumbar I have read it, and I have spoken to management, he said he will get back to me in a blase voice due to the design of the lounge.

I cant speak to HQ as its a Sunday, nor can I H&S.

in fact i am nearly sure they have to do a risk assesment for new layouts etc.

My DD1 who is 11 broke her leg at the start of the summer at a local go-kart track.

Not her fault, she got rear ended, spun round, her leg came out of the kart and got crushed.

Technically, she should not have been in a kart that size as she was too small.

It wrecked her summer - 6 weeks in plaster, I've posted about it on here. She's very active, horse riding AND a new pony to train up.

I was cross that it happened, and it was a pita for the summer, but I didn't sue.

It was an accident and nothing to gain by suing - no amount of money could've got the summer back for her

Hilarious that op now holding herself out as righteous protector of innocent children everywhere as opposed to trying to get her paws on a few quid. she makes it sound like these tables are a danger on a par with an uncovered mine shaft or open fire in a children's playground!! Thank goodness we all have the op to save our children from the vicious threat of tables in the future.
To be clear:
you can't sue them.
If you threaten to sue them they won't care, as their expensive solicitor will immediately tell them there is no merit to your case.
If you attempt to sue them you will lose and therefore have to pay their costs.
If you involve your friend at the hotel in this she will be sacked.
Now stop whinging on about this you are sounding dafter with every post. Go and look after your child instead before they cut their head open on something else.

Whatever her name change is, she has had unnecessary personal abuse.
t is possible to disagree with someone without saying "you are fucking nuts" or accusing them of trolling.

No the theme park didn't take action thats the point. All things are risk asessed BEFORE they are put somewhere, an accident won't change that if the chances of it happening can be limited. In your case better supervision of a child or an adult looking wheres its going, in my DS case obviously looking at whats he's doing too (altho thats an on going battle Smile).

The equipment is deemed safe although MY DS out of the 100's of LO a day who use the park managed to cracked his head open TWICE on the same thing. Like I sid more chance of winning the lottery Wink

How do it know its never been risk assessed checked? and don't say your friend unless shes the CEO or H&S officer.

OP i get that you don't want to sue. but why threaten it? you know it wont make them put caps on he tables because they know you wont win. the best you can do is ring H&S and leave it at that.

Mumbar I disagree, how many times does someone need to be hurt where it leaves a scar for some common sense, to say yes, these need to have covers or something to prevent them injuring further.

she high up, so yes she does know, however HQ wont listen to concerns.
