to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

the only danger is when stupid parents consider it the hotel's repsonsibility to look after their children. he is your child. it is up to you to keep him safe.

Does your mother really put plastic covers over her furniture? Where on earth do you get that stuff from? Who on earth would want their furniture covered up like that. OP, you should bow out gracefully and perhaps admit that although you've had a shit day, it wasn't actually anyone's fault, not yours, not your DH, not your son, not the hotel (was it a hotel?), not the doctors,just bad luck. You really can't think that (a) you have a legal case - you don't BTW or (b) someone is accountable. They're not. Small children fall over all the time. They are a bit of a nuisance. But that is what they do.

Nope, that's right I haven't, I have said these tables, the other tabled in the lounge area HAS plastic corner caps on (Ive already said this) these new ones haven't!

I dont care who was to blame, im not blaming anybody, I just want the tables safe!, these tables are not!

people are getting injured!, children are also, so yes I will take this further to prevent this happening, even if I cant sue!

blame tosue, she will be rolling init when she sues the well known hotel chain so we can all sue her and get a cut.

Well, why bother? Why worry? Surely you are not going to go back there ? A relaxing family lunch in a nice hotel that only lasts 45 minutes doesn't sound worth returning to.

Don't you have enough on your plate without worrying about potential future injuries to unknown persons?

You know, some of these replies are just plain nasty.

The OP has repeatedly said she didn't want to sue, but she did want some action taken to make the tables safe.

She asked would it be unreasonable to sue.
A simple yes or no would have sufficed.

She couldn't phone the HSA because they are not open until tomorrow.
If it had happened at home or in for instance MIL's house, then they would have dome something to make sure it didnt happen again.
Which is what she is trying to do with the hotel.
She has had a horrible day. Give her a break.

And as for the GA thing. I have often seen occasions where they dont give a local anaesthetic to suture a cut on a small child. A local anaesthetic involves 2 or 3 injections to numb the area, and it stings. The sutures (and it was clearly a deep cut as they mainly glue head cuts these days) involve sticking a needle in 3 or 4 times. Its oftem more traumatic for the little one to have a local plus the suture, as they have to be wrapped up and held still until its all finished.

It's not going to work as a 'ploy'. 'Toddler falls over' is highly predictable behaviour to any parent and the onus is firmly on the parent. How could it be on a business to remove anything they could bump in to? I've posted earlier (though you ignored it) about my own child's scar - caused by a rounded wooden bar!
