to sue hotel chain

We were at a well known hotel this afternoon for Sunday lunch, after lunch we were walking through the reception area where DC (13months old) fell and split open their head on the corner of the table (adult shin height) we had to ask the receptionist for medical assistance, all the while DC screaming and blood pouring everywhere.

We had to take DC to A&E where he needed a GA, however because of past expeirence with this, it was then decided that our baby would go through the treatment and the horrid trauma with no pain relief, he needed 1 inner stitch and 2 outer stitches, and next week he will have to endure it all again.

I phoned the hotel to let them know the result, and asked for safety guards on the tables to stop further accidents like this in future, they said the would get back to me, due to the "design" of the lounge Hmm

Everybody has said to sue, as its the only way they know, that this hotel will take action.

I know this from expeirence sadly also with the chain.

However I feel uneasy about it.

so they wont listen to their own staff but you think they will listen to some silly woman threatening to sue, with no hope of actually sueing all because her DH let ger ds fall over?

If your friend is that high up why hasn't she shown some initiative and bought covers for the tables out of petty cash and put them on?

exactky botty. if there have been that many accidents with these table and she knew about it, i wouldn't have much faith in her for letting it carry on.

where did dh "let" ds fall over, again unjustified and fabricated!

At least I can go to bed with my head held high with no insults thrown anywhere, like a adult does! same I cant say the same for some.

jajas that happened here only last week. a young boy of 6 got hit by a speedboat and died a few days later.

Your DH was in control of your DS's reins.

DS fell over. DH did not catch him in time.

And for the record, I've asked questions, not thrown insults.

I really have to go to bed and hope you report back tomorrow and let us know how H&S react.

BUT if you threaten to sue they may just call your bluff and nothing will happen.

I applaud your stamina for keeping up the fight but bottom line is your DS who is obviosly not in the best of health already fell and hit his head. The hotel will most likely use that as their argument and the adults cut legs as drunkeness.

Your friend the high up one needs to get the covers on expenses as anyone high up enough to know H&S risk assessing stuff will have the authority to do this and you need to look after DS and prepare both you and him for the stutches being removed.

Mumbar, it was at the Princes Club, Feltham W London. Lovely 11 yr old girl.
Fell of inflatable banana ride thing, and got hit by propellers of boat towing. Awful for her family, and indeed anyone there today.

no we are in county down, not a waterpark at a beach. he was on a body board i think. speedboat didn't see him being towed by a jetski. botty might know more. i don't know exact details.

I am at a loss as to the point of your OP if you don't have, and never have had any intention of suing them. I rather suspect you have simply changed your position for the purposes of MN because you have been so totally flamed here. There is nothing you can do about this. Just let it go. They gave no legal obligation to baby proof their tables so ate highly unlikely to do do just because you get on your ill conceived high horse.

the op has said that this hotel purports to be child friendly. to this end they have child safe plastic on some of the tables. However it is my understanding that there is a small table with metal corners which has caused more than one accident.

i do not think it is unreasonable to take the hotel to task for purporting to be child friendly.

i do think its silly to sue, which is what your title and name suggests, even though you have subsequently said you won't do so.

i do think you need to recognise that this was an accident.

i don't think the hotel were at fault, and contrary to some posters comments, i do not think you or your dh were at fault for not assessing the risk and steering clear of it as it was an accident.

I would follow the hotels complaints procedure and if you do get hold of other accident reports, in your shoes, if i felt that the hotel were fobbing me off, and after giving them fair chance to rectify the problem ,i would go to the local paper.

Sorry to be a pedant but heresay is admissible in civil cases. The rule you are thinking of only applies to criminal cases.
