Currys sent wrong fridge freezer

Curry’s delivered and installed the correct item but wrong colour. I thought it looked very dark and when you put in the item it’s the black version instead of silver.

Called them up and because the delivery men haven’t entered that it’s been delivered yet we have to wait for that and apparently someone will call us after 7pm.

I also have a freezer of food that will now have to be thrown away.

What are my rights here? Do I have to accept their replacement or can I just ask for a refund?

your responsibility was to check the item delivered. It will be all in the t&cs.

you have a freezer. So put it all in there irrespective of the outcome from curry’s

@Icebreakhell were you actually there when they were unpacking and installing it? It doesn’t take long to install a fridge, put the plug in, but usually takes a while to unpack and get in place

I don’t want to switch it on in case they then say it’s been used and won’t return it.

It's not what you ordered, they need to replace it. You informed them as soon as you knew which is fine.

It’s not obviously the wrong item, you only realise once you punch in the paperwork that comes with the fridge.

It's certainly not the case that they can just say "Oh well you accepted it!"

Use the one they delivered until they replace it. This is more reasonable than charging them for ruined food.

When you say the wrong colour how do you mean?

Did you order pink and they delivered blue?

Or is it a slightly different shade of a particular colour, light grey as opposed to dark grey?

If the colour/shade is that important to you why leave your colourblind husband in charge of taking delivery?

I am not sure where you stand as you are meant to reject at point of delivery, they may do something for goodwill but if its working and all signed for you may struggle.

If you don’t want to put all your food in the new freezer, try ringing your local Iceland or another supermarket and ask if they can put your food in one of your freezers. I’ve done thst twice over the years when I’ve had freezers break down and they’ve been happy to help out.

We had the wrong washing machine installed years ago. As part of the installation, the delivery men turned it on and started demonstrating the basic functions and that’s when I realised it was wrong. It was their mistake. They uninstalled it and fitted the correct one and said the problem would be the intended customer because the machine was now used and couldn’t be fitted as new.
Just one of those things and was easily sorted for me, but I suppose the difference was that I noticed while the delivery men were still there.
I would plug it in and use it.

T&Cs don't trump consumer law.

Also, given that colour blindness is hardly uncommon (quite possible the delivery staff suffer it too) then I would presume there is some non-subjective way of confirming the colour ordered and the colour delivered.

I imagine Currys will advise the OP to speak to the manufacturer. That's their usual way of avoiding dealing with customer complaints.

Your acceptance on delivery doesn't mean anything other than signing to say you've received it.

This is not the case that you have changed your mind or think it doesn't go- that would be different - this is Curry's error.

I sign for my Tesco order and sometimes several hours later discover something is missing from the order. My signature at the door doesn't mean I have checked all 80 items in the order, they are all present and correct and all in date, no comebacks it means "I have received the order".

Where is your old freezer? You’re not supposed to turn a new one on for 24 hours after it’s been in transit, plus the time it takes to get cold (another 24 hours possibly) you’d have needed to throw your food away anyway if you didn’t keep your old freezer.

he would have had to digitally sign that he has received correct item before installation

Correct item is stainless steel.

This one is a dark graphite, almost black.
