Hi moms! I have been involved in car accident 2 years ago! Was dropping my child to school, while i was trying to reverse back, checked my blind spots and having camera at the back, another car hit at the back while he tried to park between my car in other! Im surprised he didn’t used rule parallel parking,he just went into my car! He came out apologised, saying because same school to manage friendly, like me to fixed my car he will fixed his car not to involve insurance! Anyway i felt sorry for him , didnt want to make big deal just pain came off cost me £100!After 2 days he texted me asking because he says i accept is my fault, to pay him £1500cash! His car doesn’t cost so much money, old car 2006 with a lot scratches!I was shocked obviously how he started to play games with meand be aggressive, i told we deal through insurance! I did manage to get cctv from one of houses around! Last year claim was closed,i was happy im ok! Today surprise phone call from my insurance , the guy did reopen claim! And now they saying 50-50! I dont feel it was my fault, how many people saw this video everyone says is his fault! Even didnt stop before or indicating! Insurance says me because we are both moving and under highway code 202 rule! Plus now he is trying for body injury aswell! Wth people are doing for money, was no speed, no ambulance, he was perfectly fine! Thank you for any advice

surprised you can reopen a closed claim and that you can claim for something from so long ago… surely there is a timeframe in which you can do this?

Is your vehicle the one directly in front of the truck? Facing the oncoming traffic on the opposite side of the road? With the other vehicle trying to park behind you?

My insurance told 6 years ! But im surprised if was closed in august last year! And now reopen again this month! How is this possible

it might be reopened as injuries don’t always show up straight away. Not sure if details though sorry. Good luck. Do let them know the speed you were travelling at. If it was super slow he’s being a cheeky git. Tell your insurers that.

I don't know how it's got reopened but he wouldn't have been able to see your reverse lights and you're parked facing the wrong way (against the flow of traffic). Whilst the law isn't usually strict in terms of how you park as there has been an accident I think it was your fault, sorry.

Doing reversing what speed can be there less 5pmh! Im a mom of 2 kids , my older one went to this school,7 y same place i know how parents and kids behaving! Need to be really careful

Ah yes, I didn’t really look at the photo until @HollyBerryz pointed out you were against the flow of traffic. I can also see how they could say 50/50 because that van is blocking both your views tbh.

however, googling around it seems that they could reopen a claim if new evidence comes to light, or an injury surfaces after the accident and that’s posed to them. I have also seen somewhere that if your insurer doesn’t recover their part of the cost they may also reopen.

kind of sounds like he could have fallen for an advert along the lines of have you been in an accident that wasn’t your fault and is trying it on as I can’t see how anyone could still be thinking about such a thing 2 years down the line.

I am not even sure what you are asking.

That will probably go down as a 50/50. Tell him not to contact you any further and to contact his insurance company. Block the number from calls and ignore any messages.

Because as other people have said, you were parked facing the traffic. Therefore you wouldn't have been able to see his indication because not only were you facing the opposite way, you were on the right hand side. As soon as I started reading your post I thought "surely this is 50/50", particularly as you were both moving - when one car isn't stationary then it is much more difficult to find blame.

I was told claimants could have up to three years to make a claim, and I know this because someone fraudulently tried to claim off me and then disappeared into thin air when challenged. I remember calling my insurer shortly before renewal to ask for the claim to be closed, as they wouldn't be able to work out the next year's premium while it was open. They closed it, but warned me it could be reopened by the third party at any point up to three years from date of accident. If you're being told six years then I guess it's changed, and not in your favour.

However, the part I am struggling with most is your last sentence where you say "Wth people are doing for money, was no speed, no ambulance, he was perfectly fine!". Whatever you think, this is not for you to decide or worry about or anything else for that matter - he either claims against you for the accident or he doesn't. If a claim is successfully made, it's up to the insurer to decide if the claimant is injured - not you. You wouldn't argue what repairs were needed on the car, so don't get caught up in talking about his injuries. It really, really isn't relevant to your problem. You need to concentrate on not being blamed for the accident if that is what you believe, nothing else.

Well claims can be reopened, and it's important to make the distinction between a claim being closed as "no fault" and a claim being closed as "no claim made".

When I had to close the claim that I referred to earlier, I was not at fault, even though the other driver said I was and had raised a claim. My insurer was preparing to fight it, except that the claimant just disappeared. Therefore the claim was closed, not due to me not being at fault, but because no one was claiming off me at that point in time and I wasn't claiming for the tiny scratch on my car.

@Bonniethetiler Thank you for advice! About the cars how is parking is dependent from wich side of the road is coming the car! As you can see on left side also car how is parked! if a new in that time i should call the police!On the video is shows clearly how slowly was 2 sec reversing, but my point is the way how he tried to park! Was another car behind me! I don’t understand, parallel parking cant take in consideration?? Why after 2 days he try to get cash from , i got messages not bank transfer only cash! If i felt that time was my fault i would agree, but i know i did respect rules for reversing, checking my blind spots😞😞

one of my colleagues did work in insurance claim! She was saying how many frauds people are doing just to get money! Can go to private doctor paying £50 and will get certificate easily! Is only me afraid of God not to bed to people always helping 😢

Maybe they are, but it's not down to you or me to decide that. Only the insurance company can, based on what you tell them and the evidence (or lack of) available.

Sorry for mistakes, i so stressed, can’t stop crying, my hand are shaking! Is just present for me before Easter! I do understand people have more serious problems, and worse than this! Im just always trying to be nice with everyone and help! And i feel like many people just taking advantage on this

There is nothing to stop you from parking facing the traffic as you did, and as you say a car on the other side of the road has done the same thing. However, it does not change the fact that parking facing the traffic is rarely a good idea due to decreased visibility, and parking like you did in front of the truck, facing the traffic, with you sitting on the right of the traffic was never going to end well as pulling out around that truck would have been hell on earth.

For whatever reason, and I mean this so very kindly, you don't seem to want to focus on the facts, rather you speak of how this person was parking, and how he might want to claim for injuries which you have decided he can't possibly have, and how others have parked facing the traffic. What matters is that you were reversing into a space where someone else was trying to park. Both of you were moving at the point of impact, and it's rare for these sorts of claims to be anything other than 50/50.

@Bonniethetiler when i parked there wasnt the truck!came while i was waiting at the gates! And truck is parked in front of the gates! Thank you for your advice, really appreciated 🙏🏻

Don't be stressed, just let the insurance company deal with it. If it goes 50/50 you may not lose some of your no claims discount and if the premium goes up it won't be by much. I had an at-fault accident once and there was barely a change to my premium for the next year - I've had far bigger increases in the many years since where I've had no accidents at all.
