Apparently, the government is proposing legislation that will make protection from unfair dismissal a day one right- not as it currently is and kicking in after 2 years. Huge if true.....

Why?

That does not prevent employers from having probation periods or still get rid of employees for not performing, gross misconduct and so on.

It does make it harder for bad employers to get rid of staff just because they don't like them, their think face does not fit or just because they feel like it.

I don't see anything negative about that.

It always amazes me when people see workers' rights has a bad thing...

The same people who decide it now for workers who’ve been employed for over 2 years.

What was it before the Tories increased it to 2 years? Was it day 1 or was there a date somewhere between the two.

They need to balance it carefully, by extending some rights they may inadvertently cause a hiring bias - eg making it harder to let a pregnant woman go means some companies just won’t hire women of child bearing age.

I’m not saying it should be easy to fire people, but they do need to be aware of knock on effects.

An employment tribunal would, same as now. Query whether they have the capacity at present to deal with increased claims but - oh no, no query, they don’t.

But anyway, it used to be one year anyway /9 it hasn’t always been two years. And there are plenty of claims - complicated ones like discrimination and whistleblowing - that do not have any qualifying service now. With probation periods as an exemption, I don’t think the impact will be as huge as you might think (and all employers need to do is have a fair reason and follow a fair process - it’s not a ban on dismissals!)

Sorry but I don't agree with this at all. And I don't believe it will benefit good workers one bit. I've got plenty of experience with colleagues who were terrible at their job and generally just annoying to work with crying foul when they eventually lost their job over it.

I work in HR. Protection from unfair dismissal should be a day one right. I didn’t vote for Labour but I definitely welcome strengthening workers’ rights.

People have mentioned this might be at the expense of small businesses. If small businesses are choosing to screw employees over just because they’ve got less than 2 years service then I welcome the impact on them too. All workers should be treated fairly.
