Accused of posting on someone's LinkedIn...

Bearyhumcrack · 14/05/2021 06:58

I work in a public sector organisation and have been called in by my line manager to say that I have posted something offensive on someone's LinkedIn page and of causing offensive comments on twitter. Confused

I have a LinkedIn account but don't use it much, I do remember following and unfollowing this person a few months ago but no recollection of posting on their page. Is there a way I can check whether I commented without looking at their profile? I know they can see if I have looked at them and I don't want them to make any more allegations about me.

Jesus christ I can't believe he is refusing to back down and bloody apologise! His wife much be on the gin 24/7 just to cope.

Keep going OP, I hope you can sue him and the company inside out

CliffsofMohair · 16/11/2021 21:38

@Bearyhumcrack

HR have asked for the recordings and transcripts as part of my response to the disciplinary. I'm still not convinced about this but I have lots to put in an appeal and then there's the complaint.
Are you taking legal advice
Alpinechalet · 17/11/2021 11:50

If you end up at an ET you would have to disclose the recordings and transcripts then.

However, the issue now is have you broken any policies by recording the meeting? As pp said get legal advice or at least contact ACAS.

You could ask for written assurance that if you provide a copy of the recording you will not be subject to disciplinary action for making the recording.

BlueJay2 · 17/11/2021 12:03

The OP confirmed in her post of 4/11 that she has taken legal advice and is acting in accordance with that advice.

FatCatThinCat · 17/11/2021 12:50

What a ridiculous and unnecessary drama over a tweet they're not even accusing you of posting. Any competant manager would have had this done and put to bed the day it came across their desk.

SliceOfCakeCupOfTea · 17/11/2021 13:15

I was thinking about this thread the other day, wondering hoping it was all over.
So sorry that it's not. I've got everything crossed for you!

Bearyhumcrack · 17/11/2021 14:41

Yes as pp said, legal advice was to tell HR that I have recordings which prove he's lying and to ask them what to do with them and where to disclose them to. They gave me that direction yesterday.

I have no faith in the organisation so let's see how it goes.

RandomMess · 17/11/2021 20:24

I hope he utterly craps himself when he finds out you taped the meeting!

Justkeepleft · 17/11/2021 20:53

I hope that finally shows the higher ups how ridiculous this is.
You are still sitting on the other points, such as the privacy breach for the complaint ,is that right?

Bearyhumcrack · 18/11/2021 08:28

@Justkeepleft yes. Every time I'm near to finishing the complaint, he does something else! But that is all in there Smile

Bloody hell the whole thing reminds me of arguing with a child, when they just keep digging a bigger and bigger hole and getting in more and more trouble Shock. Unlike arguing with a child, nobody is saying to him "look this is getting silly, go and sit in your room for half and hour and think about if you really want to go down this road".

Hang in there, it sounds exhausting.

Justilou1 · 21/11/2021 21:24

Call their bluff… just say that you’re keeping it for when you go to tribunal

50ShadesOfCatholic · 22/11/2021 21:47
@Justkeepleft yes. Every time I'm near to finishing the complaint, he does something else! But that is all in there Smile
Oh to be a fly on the wall when he learns you have recorded him. Although he sounds so dim that he may still imagine he can worm his way out of it.

This really is an utterly bizarre situation. How can anyone respond to a complaint without being aware of the contents.

Actually I went through similar, I was informed I had transgressed and was fired but at subsequent appeals was denied access to contents of apparent complaints. Absurd

Went all the way to tribunal when they STILL refused to share contents of complaint citing privacy concerns. Tribunal told them to stop being ridiculous.
I won and was awarded a payout beyond the ceiling for unfair dismissal because the panel said the case was so extreme. A year's salary and my job back. I note that the people involved "left" the company around the same time.

I got a better job though and had the glorious satisfaction of turning down an application by a former manager.

Just keep being true, it's all you can do. I know it's shit at the time but one day you will look back and laugh.

wheresmymojo · 22/11/2021 22:56

Oh OP...I remember reading your thread when it first started.

You're so much more patient than me, I think my head would have exploded from anger by now!

Perrymenopausal · 25/11/2021 06:02

Hope you’re okay OP.

I’ve been following thread from the start.

Dh been in similar situation, it really drags on doesn’t it.

We had a very favourable outcome in the end. Keep fighting.

Bearyhumcrack · 26/11/2021 06:10

@Perrymenopausal you're not wrong! Resigned to it not being resolved this side of Christmas...

OP posts:
winewolfhowls · 26/11/2021 07:13

Keep strong, you are doing amazingly well. It's all just so bizarre and all a todo about nothing you couldn't make it up.

treesandweeds · 26/11/2021 07:48

I'm wondering how you can be accused of influencing someone to post something. Are they suggesting you have psychic powers? And is that against work policy?

Bearyhumcrack · 26/11/2021 10:15

@treesandweeds I have no idea. And as far as policy... they seem to be picking and choosing whether that's important or not!

OP posts:
CottonSock · 26/11/2021 10:26

I don't know how you have found the strength to go to work. You are incredible and I have no words for your boss. I won a grievance with my employer a couple of years ago. Keep fighting and good luck.

CottonSock · 26/11/2021 10:29

And do contact ACAS even just for advice. I raised a tribunal request which sat open till the internal investigation was concluded, but must have had an impact I imagine.

jpbee · 26/11/2021 11:10

Now you have seen the tweet which started all of this, is there any potential link between the tweet/person posting it and the photo of you as a child? Because the childhood photo is one of the most disturbing details you shared in my opinion.

I'm so sorry you have gone through this. I've actually found the thread and your handling of this admirable and inspiring. I can imagine the temptation just to run away from it all whilst suffering with anxiety, yet you have persevered which is incredible.

Allmyarseandpeggymartin · 04/12/2021 19:12

How’s it going @Bearyhumcrack

Hope you’re okay

Bearyhumcrack · 04/12/2021 22:02

@Allmyarseandpeggymartin no change! I've heard absolutely nothing so...

Resigned to nothing til after Xmas now, that will be almost 8 months since I was first accused.

OP posts:
FireworkParrot · 04/12/2021 22:57

Do contact ACAS as a PP says. They can offer mediation and general advice but to be honest I'd take this all the way to tribubal. I work in HR and my jaw is on the floor at how appalling this whole situation is.
