Tier 3 home but going on a tier 2 day out?

Absolutely aware that everyone has had a shitty year, and that we're all suffering and having to make sacrifices.
However, DH and I have had a particularly shitty year, and Xmas, and a friend has offered to look after our son tomorrow if we want to spend a bit of time together. I would really like to travel to our nearest town, which happens to be tier 2 as opposed to the tier 3 we live in. We could have a spot of lunch somewhere and a walk around. I know this is technically not OK but it would be such a treat.

Should we go for it, or will you all rip me a new one for suggesting it?!

My year has been shitty, so we are on. We can meet in a tier 2 half way between us. I live in Birmingham. There might be a tier 1 somewhere close. Or is that too risky?

Oh no don't worry, it will end. It's only a little meal, its not like we don't deserve a time out from it all

If you give a tier 3 address to a tier 2 restaurant for track and trace the restaurant can report you. It is a £100 fine per person.

If you give a tier 3 address to a tier 2 restaurant for track and trace the restaurant can report you. It is a £100 fine per person.
They don't ask for addresses though, just a contact number. I've done this twice in the last month. But the case numbers where I live in tier 3 are only marginally higher than our neighbouring tier 2.

What's the actual offence?

I think from looking at that leglisation that:

  1. Pubs can only offer takeaway in Tier 3
  2. People in Tier 2 and tier 3 can meet in their household (or bubble) inside.

So according to the law, someone in Tier 3 can meet inside. They can't go to a pub in Tier 3 as the pubs are closed but they can go to a pub in Tier 2.

Bring them all. Rule of 6 won't apply if u have a shitty year. Oh my mate has recently become single. I would love nothing more to see her and her 3 babies. Will bring her among too. Not sure her year has been shitty enough though.

Dh and I have had a particularly shitty year. My family is luckier than most but given the amount of people I know this year who've had a 'particularly shitty year', almost no one would be following the rules because they deserve a treat.

I see that. But in Tier 3, you are allowed to be in an indoor space . It's just that the pubs have to close.

It doesn't say you can't go to a pub. It just says that the pubs have to close.

Interesting. I see what you’re saying, that the legislation for tier 3 doesn’t actually say you are banned from a pub....more that the pubs are banned. So the stuff about taking your restrictions with you might not be valid.

Well in that case it would be interesting to see what happens if something challenges a fine.

I live in a city that appears to have given lots of fines out to people. Will be interesting to see what happens.

Your tier goes with you so as someone in tier 3 you can't mix with others indoors etc

Yes, but @chomalungma point is that in tier three it doesn’t say you can’t go in a pub. It says the pubs must be closed. So,for people,from tier 3 who have got a fixed penalty for going in a tier 2 pub that could be an important legal distinction.

The govt may have meant for tier 3 people not to go in a pub in tier 2, but if it’s not written in legislation it’s not law.

I'm in the same tier (4) as my parents who live down the road. I can't even have a cup of tea with my mother so bollocks to everyone doing exactly as they want. Thanks for dragging it out longer.

But you can be with your household in an indoor space.

I live in a tier 3 area, I personally have not been to the pub. However a friend of friend did and recieved an £100 fine in the post.
