Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

Apologies I hadn't RTFT

PhylisPrice · 20/09/2020 16:21

Absolute wankers! They are going to really regret this stupidity once it goes through court. Keep us updated and I hope it's not too stressful a process and you find a better job soon!

LeaLoo82 · 20/09/2020 16:37

Thank you so much for the advice, I’m gonna have to try get into work ASAP but the whole situation with shitty covid I’m thinking job interviews will be rammed so I’m gonna have to just apply for everything.

I’m gonna phone Universal Credit in the morning as my mat pay ends after this payday

Good luck for tomorrow @LeaLoo82. You sound well prepared.

In the meantime this might help answer some of your UC queries.

I would hold off on universal credit until you get this information in the post. If you have been made redundant then you should be receiving redundancy pay and pay in lieu of notice (pilon).

HeartGirls · 20/09/2020 17:32

@LeaLoo82 OP would you be happy to return to work if your boss is found to have forged your resignation and sacked? I'm assuming you have no issues with anyone other than him

Mamagotskills · 20/09/2020 17:37

Wow! so was there redundancy pay? Get in touch with pregnant and screwed

neverenoughchelseaboots · 20/09/2020 17:39

Was just going to say the same as @Mamagotskills Pregnant Then Screwed would be helpful to speak to as they have free advisors in exactly this area.

BuggerOffAndGoodDayToYou · 20/09/2020 17:47

Take them to the cleaners OP!

nhsnamechange · 20/09/2020 17:54

Bloody Nora!!! Go get your money op!!! Scandalous!

MusicTeacherSussex · 20/09/2020 18:08

Brazen! If he can't produce a copy of your resignation that is clearly authentic and from you (which he won't be able to) then he is in DEEP DEEP shit. No mercy.

Newnamenewopenme · 20/09/2020 18:19

Fingers crossed you get a big payout and can afford a year off living like a billionaire!

Loftyloft · 20/09/2020 18:19

That’s outrageous!

Does the boss also own the company or just manage it? I’m assuming it’s a one man band to act with so little regard of the law.

Save and screenshot all communication.
Don’t do anything verbally only in writing.
Haul him over the coals.

And keep us updated Grin

Fishfingersandwichplease · 20/09/2020 18:47

My job got made redundant when l was on mat leave years ago - another full time post came up and by law they had to offer to me, my employer didn't and when l spoke to acas they said very clearly it was discrimination and l could take it further assuming l wanted the job. I didn't want it as it goes but the law was very much on my side as l am sure it is yours OP.

Itsatoughgig · 20/09/2020 18:58

@LeaLoo82 hope the appointment with the lawyer goes well tomorrow

honkytonkheroe · 20/09/2020 21:33

Good luck for tomorrow!

EasterIssland · 20/09/2020 23:14

Best wishes. !

DetectiveRandySomething · 21/09/2020 05:28

If it's the company I used to work for then I'm not at all surprised.

CatsCatsCats11 · 21/09/2020 06:09

That's actually disgusting, hope all goes well with the lawyer

LittleRen · 21/09/2020 06:35

How long have you been there as it’s hard to claim unfair dismissal if then two years. How awful for you... hope you get it sorted.

LittleRen · 21/09/2020 06:37

Oh of course the element of maternity protection would probably override that anyway. Ignore me!

user1487194234 · 21/09/2020 06:37

She has been there 8.5 years and even if she hadn't the 2 year thing does not apply in cases of discrimination

Nikhedonia · 21/09/2020 10:14

Don't forget your entitlement to holiday and bank holidays accrued whilst you were on maternity leave, OP.

Good luck at the solicitors.

MrsSchadenfreude · 21/09/2020 10:42

They must be extraordinarily dim.

Good luck for today!

FinallyFluid · 21/09/2020 10:48

This is jaw dropping.
