Livin, would the legal board be able to help?
I know some things have a 6 year cap on them. 9 years is a very long time.

LivinLaVidaLoki · 11/09/2020 18:28

I've just checked online @TrustTheGeneGenie and its 6 years. But I'm scared to death that if I contact them and explain this they'll just put it in dispute and start the clock again claiming that its not their fault I didnt get a letter etc and so they're going to take me to court or something (which surely would cost them more than I owe as my biggest debt was 800 pounds and I paid that). I've worked so hard and my credit rating is perfect (its how we got a mortgage and remortgage at such a good rate) and I don't want to damage that.
So I'll phone CAB on Monday and see what's what. From what I can see of other peoples experience online these companies buy old debts and then go on fishing expeditions on the off chance someone will cough up.

InsaneInTheViralMembrane · 11/09/2020 18:32

@LivinLaVidaLoki my specialist subject. 😁 1) if you have had no contact with or acknowledged the lender within 6 years then the debt becomes “statute barred” which means it is no longer recognised and can’t be chased. Note this is six years from you “not opening your post”, not 6 years from the credit agreement.

 1. your original agreement was with “Lloyd’s” not the collection agency “thug & thug co”. You do not give money to people you do not have an agreement with.

 2. the agency likely bought the debt from “Lloyd’s” for pennies in the pound and they’re just going to try their luck and some people will get scared and pay up. Don’t!

 3. if the twats try and send you a court summons don’t ignore it. Do ask for them to supply the original credit agreement with the collection agency - and ask for a motion for it to be struck off due to statute barred.

 4. you can use the law to send a letter saying “don’t ever fucking contact me again” to the agency and “don’t ever sell my fucking data you gdpr breaking bastards” to Lloyd’s. Frankly it’s unlikely they will have your original hand-signed agreement anyway.

These pricks trade in fear.

Let me know if I can help more. Xx

I had one pop up united utilities when I cancelled a phone contract they said return phone so I did. Two months later saw money still going out £80 so cancelled the DD. Was threatened then because I had not returned the charger all this on a five year old phone rarely used. I had kept all the correspondence so copied and sent that all went quiet. Then they sold the debt on two years later and it all started up again so I sent all the paperwork in again, googled the company absolute shysters from Liverpool. It did go down against my credit though so I insisted I wanted to see them in court. They ignored me after that.

LivinLaVidaLoki · 11/09/2020 18:41

You're a star @InsaneInTheViralMembrane thank you. I had a feeling it was an opportunistic fishing trip, as the letter is so vague.
Its also addressed to me in my maiden name. I've been married for 12 years.
So am I best getting in touch with them? If so what do i say? I'm just wary that anything I could send them will be construed as me acknowledging the debt and the 6 year clock restarting.

Supermarketworker06 · 11/09/2020 18:42
@Supermarketworker06 Really sorry people are being arses Sad. Even if you're eye-rolly about the rules its totally not fair to take it out on the staff.
Thank you. I'm a pretty capable, just get on with it type of person, but the shit behaviour of a select few wears you down and makes you on edge to be unnecessarily snappy with others. You're always looking for the "that one is gonna start" customer, and for the supervisors it's even worse.

Littlebelina · 11/09/2020 19:11

Have a look on the moneysavingexpert website as well @LivinLaVidaLoki, think they have a template letter you can use. insane's advice is spot on.

I hate those companies, I get letters occasionally due to someone with the same name having a debt, every so often it gets sold onto a different company and I have to explain it's not me.

DominaShantotto · 11/09/2020 19:43

Well there's well over 6 next door in the garden getting pissed at the moment. Resident curtain twitcher poisonous busy body is out there in full flow slagging everyone off.
It's a shame I'm in the conservatory and sound carries more than through brick (we have one wall solid UPVC panels as it's against the fence and the sound proofing on it's not great) and I can hear every word (I know what she's like anyway).

PickAChew · 11/09/2020 20:09

The situation in the NE is pissing me off someehst, tonight. My county isn't on the watch list but it's been affected by the sane bloody football match that hammered Sunderland.

All our own outbreaks seem to be bloody working mens clubs.

AgentCooper · 11/09/2020 20:15

@chocolatesweets

Things are creeping up again aren't they? Feeling claustrophobic again today. Even though kids are starting playgroup next week, I just doubt it will happen. I know schools with confirmed cases where bubbles have been sent home. I feel like I can't breathe and on the verge of a panic attack.

Anyone see the panorama advert with SEN kids. Reduced me to tears. I've worked with SEN kids and I'm also a parent. I just can't imagine zero support with challenging kids. Heartbreaking.

But at least we are all "safe".

I'm sorry, bad day. I'm tired. I need a life.

@chocolatesweets I saw that Panorama clip. It had me in tears. The way that family were treated was totally inhumane and cruel. My goddaughter has additional needs and all her CAHMS appointments were cancelled with about a day’s notice, told she wasn’t priority. Her mum had to homeschool when the schools were shut and the poor wee soul struggles so much. Not fair on either of them.
DominaShantotto · 11/09/2020 20:22

DH is having a massive row on the phone with MIL who is insisting that St Nichola is being ever so safe and face masks are magic and will protect you. I'm proud of him cos he never stands up to her and challenges her.

RealityExistsInTheHumanMind · 11/09/2020 21:01

I've just watched (well skipped through because he rambles) a Doctor John YouTube on Vitamin D.

The video is mind numbingly boring but the information is excellent.

79 people with known low Vit D were admitted to a hospital.

They gave them all the acknowledged best treatment but 50 of them had added vit D. So 50 had extra vit D and 26 'best' treatment.

The 26 that had the standard treatment 13 ended up in ITU and of those 2 died.

Those given the additional Vit D, 2 ended up in ITU and none died

That sounds pretty conclusive to me.

Get your vitamin D folk - and especially for older or more vulnerable people. D3 (not D2) in an oil base capsule. (Back it up with vit K2 if you can afford it) But vit D does so much for our health regardless of Covid. Please research it and consider it.

InsaneInTheViralMembrane · 11/09/2020 21:05

@LivinLaVidaLoki don’t worry about it. Send the letter off (from MSE) and consider it no more. Do take it seriously if there’s a court summons. Judges hate these companies trying it on but if you don’t present a defence they can’t help you.

It’s the same with bailiffs who will tell you they can “take everything”. They can’t - they’re just hoping you’re scared and uninformed. They can’t go in the kids rooms, they can’t take your white goods, your table, your chairs, your electronics (gdpr) or your tv if it’s wAll-mounted - and if you’ve got kids I think they need to leave the tv anyway.

So when it comes to it all they CAN take is those 150 DVDs under the stairs you couldn’t decide what to do with and the 15 year old ikea bookcase you couldn’t be arsed to take to the tip.

But yeh. They’ll tell you anything and try and trick you into signing a payment plan. They’ll try stuff like clamping your car to frighten you - which is an offence if it’s on finance or HP.

JamSarnie · 11/09/2020 21:06

Get your vitamin D folk

I have been taking vitD3 for about 18 months as realised with my age that I probably needed to. Have to say it might be coincidental but I have had less colds and generally feel better.

DH having read up on the research has now decided he should also take VitD supplements.

Bollss · 11/09/2020 21:07

I take vit d! I started because I worked in a windowless office and presumed I lacked it. I was also advised it can be beneficial for asthma so I carried on. Makes sense it would help with this too!

RealityExistsInTheHumanMind · 11/09/2020 21:22

@JamSarnie
@TrustTheGeneGenie
It really is worth it. My family weren't convinced initially when I started pushing it having done research, but those I didn't get through to before take it now. We are all fair skinned but protect ourselves from the sun because of it so we definitely need it.

The research was done in a Spanish Hospital, (and I checked the link, it is genuine). The Spanish often avoid the sun now many work inside so they are susceptible to low vit D.
Not just Covid, it really is something most of us could do with more of.

@RealityExistsInTheHumanMind
Chatting to my friend today, who lies in Bournemouth and her words
I’m so brown I look like I have been dipped in tea

She’s been taking vit d3 but not with k2 which you need to help it absorb

Then she dropped the bomb, I’m always covered in factor 30
I wonder if there’s something vital in the suns rays to help with the conversion that factor 30 is stopping
It’s certainly worth considering

SomewhereEast · 11/09/2020 21:38

We've been taking Vit D since the early summer as I read something or other suggesting a link between Vit D deficiency and bad Covid outcomes and thought "What the hell. Won't do any harm..." Good to know about K2!

JamSarnie · 11/09/2020 21:46

I have both vitD3 and a multi vitamin. I also try and take a break outside and just sit in the sun for a bit each day.

110APiccadilly · 11/09/2020 21:53

I take vit D because you're told to when pregnant. I also try and spend some time outside, will have to work on that note over winter I suspect. I do burn very easily but even in a bright day I try to spend a bit of time outside before I put my suncream on, if that makes sense!

RealityExistsInTheHumanMind · 11/09/2020 22:00

Few people take K2 - it's not essential but it increases absorption and if you are taking large amounts of D3 it reduces the chance of overdose.

OP posts:
Taswama · 11/09/2020 22:22

I don't think the sun is strong enough in the winter months in the UK Picadilly so you will definitely need vitamin D.

PickAChew · 11/09/2020 22:36

I'm very fair but try to get out before 11 or after 3 from May to July. I don't like relying too much on sun block, anyhow, as I inevitably miss a bit and burn to a crisp in that one place.

WouldBeGood · 11/09/2020 22:40

I take vitamin d and so does ds. DP was diagnosed with MS and his consultant recommended high doses all round.
