Really nervous for today

My ex owes over 6k in child maintenance. The CMS have actually been really good about pursuing him and today is D day.

His house sale is going through and he’s expecting the equity to go into his account. CMS enforcement are planning on freezing his account at some point today and hopefully recovering the money he owes. I’m so nervous they are going to miss the window and he will remove the money ASAP. He doesn’t have an onward chain so it isn’t going to mess anyone else’s house sale up.

I’m hanging on the phone waiting to hear if they’ve been successful. And if they are the fallout from him will not be pretty, luckily he lives hours away so very unlikely to turn up here.

At the risk of stating the obvious, I presume you've got caller ID so you can filter out any calls from him?

I would assume they already have a high court order signed and placed against his account and the bank has to abide by the law and not inform him. Otherwise how does it work?

Their enforcement team have a lump sum deduction order against him. They know the solicitors the money is coming from, I think the plan is to seize the money before it even hits his account.

Trying to distract myself. I don’t have his phone number so can’t block him (haven’t seen or heard from him in over a year), won’t be answering any calls from unknown mobiles today though. CMS comes through on unknown caller ID so I’ll have to answer those calls but if it’s him I’m planning on just hanging up

Fingers crossed that this works out for you. How are they planning to get him to pay in the future? As you say, he isn’t going to be pleased? Does he have any contact with the children?

I have had one of those ex's and the CMS were quite good in the end at extracting all the money he owed out of him. Fingers crossed for you today, let us know how it all goes.

No contact with DD at all. He had very regular contact for 3 years, got a new partner and dropped off the face of the planet. I have no idea where he lives except a vague county across the country. His own mother told me his house sale was completing today!

I’m trying not to get my hopes up and just thinking well I haven’t lost anything if it doesn’t happen. The CMS have other tricks up their sleeve if this doesn’t work, my case worker is fabulous and has worked really hard to get this deduction order. They can only attempt to seize money once a year and they already tried a few months ago, but she has pled my case that we know he will be in receipt of substantial funds today,

I won’t see the money for a while as he has a right to appeal, either that he’s already paid me (he hasn’t and will have to prove it) or that he can’t afford it. CMS said if he does withdraw the money before they can get it then it will be a fatal error as no judge will look kindly in the future on the fact he had funds and chose to not pay.
