Really nervous for today

My ex owes over 6k in child maintenance. The CMS have actually been really good about pursuing him and today is D day.

His house sale is going through and he’s expecting the equity to go into his account. CMS enforcement are planning on freezing his account at some point today and hopefully recovering the money he owes. I’m so nervous they are going to miss the window and he will remove the money ASAP. He doesn’t have an onward chain so it isn’t going to mess anyone else’s house sale up.

I’m hanging on the phone waiting to hear if they’ve been successful. And if they are the fallout from him will not be pretty, luckily he lives hours away so very unlikely to turn up here.

@Funnyface1, yep, but this is the end of a long road where he has done everything and anything to avoid paying. He was even taking the plates off his vehicle to stop it being seized. He isn’t stupid and will remove that money the second it hits his account.

Update and it’s not good news. The solicitor has said the money will be in the account in the next 30 mins.

Have spoken to CMS and they have said they can only attempt to take the money at the end of the day. It will be long gone by then. Actually feel gutted. Seriously gutted.

I often wonder what happens to parents who don't think they should have to pay maintenance, at what point do they convince themselves they are somehow absolved of responsibility?
My exs wages had to be arrested and I always wondered how he thought his outgoings were more important than his daughter

I don't know anything about this process but from your last post, this seems like an incredibly inefficient way of working, the CMS I mean.

So all that work and preparation is going to be for nothing because they can't make an immediate seize of the money? Ridiculous.

Really sorry OP, this must be incredibly frustrating but surely there are other avenues you could try in order to retrieve the money? Small claims court perhaps?

Surely if it's a lot he won't be able to withdraw it all in cash today? At my bank you have to order more than a couple of grand in advance?

@VisionQuest, it’s utterly infuriating. They are a government agency so presumably could choose to do what they want. I don’t think HMRC would be so toothless. The fact they are only allowed to freeze funds once a year is absolutely ridiculous. It’s just not a priority for the government

It is so frustrating. The money going into the solicitors should be treated as any other bill owed following a sale, the solicitors retain X amount and forward the balance to your ex in this case.

If they freeze his account surely he can't withdraw or transfer funds? I hope thats the case and you get your money x

With online banking it is so easy to watch for money coming in to an account & move it straight out, his account should have been frozen from close of play last night to prevent this happening. I know your caseworker has done her best, but unless they step up the pressure this money will never be recovered.

She’s gutted. Enforcement team are acting with the powers they have apparently. They do have powers to put a lien on a property but they have to do everything else first and he’s sold the house before they could.

It’s the same with removing driving licences. They have the power to but they never do. Why are we not removing passports, driving licences etc from these *men

Well there seems to be a rather fundamental flaw in the system then! It just seems like such a massive waste of everyone's time. A years worth of work all leading up to today, all for nothing. You have been hugely let down.

Does he know that there's a chance the money could be taken by CPS though? If not he may not think to move it straight away?
(grasping at straws...)

If he does move it before they can get it, at least like you say the judge will look unfavourably on this as he had the ability to pay, however brief it will look on the books.

Haven't heard anything from the CMS or from ex. So i'm guessing no movement at all. I feel absolutely gutted
