Relating to the ectopic pregnancies in particular

HB182 covers insurance.

HB413 specifically discusses reimplanting a pregnancy. It states "abortion murder" is a crime punishable by imprisonment and also introduces a new crime called "aggravated abortion murder" which carries the death penalty.

What it comes down to is barriers, as many barriers as possible thrown into the path of women.

I expect this will go to the Supreme Court one day

It won’t as this isn’t about legality but payment. Having to pay for it yourself isn’t considered an “undue” burden, remember we are talking about US healthcare which isn’t considered a human right. And that’s a whole other debate btw

(I don’t agree with this to be clear just saying this is the situation in the US)

MangoFeverDream · 01/12/2019 11:24

Apologies. I see there is a new bill in just the past days.

Yes, that bill will not survive in the courthouse. It’s not going to even go to the Supreme Court, but will fail in one of the lower courts. However, the truth is that the Ohio prolife lobby is extreme and very persistent. Also, tends to be women-led. These bills always get struck down so I never get very worried about it. However, they are definitely headline grabbers, as they are meant to be. They are like PETA, just pulling dumb stunts that don’t go anywhere.

Their usual way is to chip away at access, like in the insurance bill.

MangoFeverDream · 01/12/2019 11:25

I should say, though, that chipping away at access is actually more insidious, because people don’t pay as much attention to that ....

@MangoFeverDream, you’re wrong - Rep Becker is talking about an entirely different bill. His bill (182) is about insurance coverage; but bill 413 is about “abortion murder”, and seeks amendments to criminal law, negligence law and professional/disciplinary processes against doctors .

You can see the full bill here: legiscan.com/OH/text/HB413/id/2062004/Ohio-2019-HB413-Introduced.pdf

Specifically, the physicians’ defence (it’s at page 184) to a charge of abortion murder is restricted to the following:

“Sec. 2904.35. A physician who does all of the following is not subject to criminal prosecution, damages in any civil action, or professional disciplinary action, for a violation of this chapter:
(A) Using reasonable medical judgment, believes it is
highly probable that the pregnant woman will die from a certain
fatal condition before her unborn child is viable;
(B) Performs a surgery, before the unborn child is viable,
for the sole purpose of treating the pregnant woman's fatal
condition;
(C) Takes all possible steps to preserve the life of the
unborn child, while preserving the life of the woman. Such steps
include, if applicable, attempting to reimplant an ectopic
pregnancy into the woman's uterus
.”
