That is the point which cannot be proven and therefore in actuality and law a murder conviction was always impossible.

They were passengers in the car so could not be charged with murder as they were not driving.
The driver of the vehicle has been charged with murder and is not eligible to be released early.

Please don't think that the issue of prisons being on crisis is a current government issue. They have been on the point of crisis due to lack of spaces for years. The delay in court proceedings during that started during COVID, the fact we lock so many up, lack of prison officers - it's been years in the making. They have been quietly moving prisoners who would not normally be eligible to low security prisons for a long time.

Let out early and back to the site that's had £4.2 million of public money spent on it.

We all know they knew. How could they not? If you drive a car you certainly would know if you're dragging someone behind you. I know they are apparently illiterate but you don't need to able to read to know if a car is lurching about someone is being dragged.

I do think it’s awful they’re being released early but the government aren’t doing this for shits and giggles, The last Tory government didn’t build a single extra prison but at the same time increased sentences. Everyone working in criminal justice system have been saying for years that there was going to be a massive crisis. The Tory’s knew they were going to lose the next election so instead of building prisons gave everyone a 2% NI cut. A Fucking insane and negligent thing to do.

This government can’t magically come up with extra places. They have already provided an extra 2000 prison places and have started building new prisons. That obviously never gets mentioned in the media because the media LOVE an argument.

It's not all about the risk to the community. The criminal justice system is meant to protect society, punish for crimes committed, deter others from criminality and provide chances for rehabilitation. In that order. You think we have that balance at the moment. Judges decided, as a self perpetuating and pretty much closed group think, that they think opportunities for rehabilitation should be their main objective for anything but the most heinous crimes.

IIRC , if the charge is murder and they are found "Not Guilty" * then they are free to go .
A lesser charge of Manslaughter is more likely to get a conviction. Not as long a sentence but preferable to them walking free .

I can’t forget their behaviour in court. They had not a shred of remorse. There is something seriously wrong with people who think and behave like that.

Releasing any woman prisoner in for petty theft, shoplifting, minor personal drug offences, fraud and other non violent crimes would free up how many spaces? Is there any reputable figure on that I wonder. I don’t know enough to know how different prison systems housing those women would be to housing violent male offenders would be but I cannot begin to believe it isn’t possible vs releasing violent males like those in the case quoted .

Politicallly, this is a massive unforced error by Burnham. It marks the end of his honeymoon period, just as the winter fuel announcement marked the end of Starmer’s. Just like winter fuel, it will cut through to people who don’t usually follow politics & will define the rest of hie premiership.

Being soft & weak on crime might be popular with Guardian reading lefties who hate Britain but for the rest of us it tells us whose side Burnham is really on. And it’s not the side of brave police officers or protecting decent law-biding members of society from violent criminals.

Exactly I do not understand why this is such a flashpoint issue. No one is proposing those people are going to be let out imminently.

You think there is anyone in prison fitting that criteria at the moment. None of that has resulted in prison for years, unless you are on the 10th plus. Then it's not 'petty' is it.

They had just stolen a quad bike which was previously being towed.

How do you prove, beyond reasonable doubt, they knew they were towing a person and not a quad?

If you know they knew, why did you not provide this evidence to the prosecution to use in court?

Manslaughter was the right result in this case. It secured a conviction and jailed them. Murder would never have stuck.

Yes they are, that is exactly what is going to happen. They will be release in trances, starting from October for the proceeding 9 months so fairly imminently I’d say.

the offenders in question here will be released. The offence exclusions have been confirmed. Manslaughter is not one of those exclusions, therefore they will be released at 33% or the relevant trance date
