SMP/MA advice please!

Need some advice about SMP and MA, as I'm going round in circles.

My company folded and I was made redundant just after I should have to applied for SMP.

The DWP have just informed me I am not entitled to SMP as I didn't send in my MATB1 form to the administrators, even though I was verbally (by our HR dept) told not to as the company was just about to fold. I understand they were possibly wrong to say this, but I took their advice as being correct at the time.

So do I just proceed with claiming for Maternity Allowance instead (would this be straight-forward?) or do I continue to push for my SMP which I was fully entitled to?

As both are paid at the same rate, I'm not overly bothered which one I get, as long as I get something.

Help!

fraid I don't know the answer but a tip-
if you do get SMP you can do as much self employed work as you want during your maternity leave (so long as you are registered self employed) if you get MA you can only work the 10 KIT days. Is a loophole but very handy for doing odd bits and bobs to keep a career going.

But think MA is relatively okay to apply for.
