Holiday pay in maternity leave

hattee · 13/01/2010 16:06

Can anyone tell me if I am entitled to additional holiday pay please?

I started my maternity leave in March last year, and I received full pay for my remaining annual leave for the calendar year. My maternity leave officially ends in March this year (though I am not going back to work). Am I also entitled be paid full holiday pay on a pro-rated basis until March?

thanks

This says you are entitled to the leave but not necessarily the pay.

DeidreB hattee is definitely entitled to be paid for her holiday accrued during maternity leave, as is anyone else. That link doesn't say any different.

The only thing it does say regarding holiday pay is that employers can't pay in lieu of holiday accrued unless the employment is ending. Holiday must be taken and will be paid as normal.

In hattee's case her employment is ending anyway, so assuming she doesn't manage to take all her accrued holiday before her termination date, her employer will have to pay her in lieu of it.
