Annual Leave booked but now off sick?

Do I get my AL days back for the time covered by the sick note, or is it at the discretion of the eployer?

You are entitled for your AL days back, as you were covered by the sick note. NOT employer's discretion. Make sure you ask for them if they don't offer them to you.

There was a new ruling only last month which means you ought to be able to claim back your holiday days, but it's entirely likely your employer's policy won't be up to date and they may not know.

If you have a Human Resources team or an annual leave or sickness absence policy it might be best checking what it says. However if you dont then maybe ACAS website or their helpline could offer advice as to what employment law states.

All sorted...my sick note ran across 7 days of AL I had booked, and I just rang my boss and got them all booked in for December. Result!
