Entitlement to bank holidays for part time workers

Hello

I'm sure this has been asked a million times before but are part time workers legally entitled to a percentage of bank holidays as part of their annual leave? I'm going back to work 2 days a week in a couple of weeks and I'm planning to do Tuesdays and Wednesdays. Am I legally entitled to a percentage of the bank holidays that fall on a Monday?

not sure about the law, but at my old place they failed to suss (for several years) that p-t workers who worked Mondays got an unfair advantage. when they realised they put in place a system whereby p-t workers got a total leave allowance that was the equivalent to normal f-t leave, plus bank holidays, then pro-rated down. and then they would have to book bhs off. If you're just starting a new job I think you'll have to ask what their system is. and if it's not fair you should have a bit of a whinge. (albeit a very eloquent, polite, well-arged one...)

As a part timer you cannot be disadvantaged compared to a full timer. So if full timers get bank holidays extra on top of their annual leave, then you should get an appropriate proportion of them.

There are 8 bank holidays a year, and as you work 2 days a week, you will be entitled to 2/5 of them. 8 / 5 x 2 = 3.2 bank holidays a year.

There are two ways of doing it. Depending on when Christmas and New Year fall, it may be that some years you actually get 3 of those anyway. Some years you won't. Your employer could either sit down with you at the beginning of each year, see how many bank holidays will naturally fall on your normal working days and add in however many days are necessary to make up your entitlement. Alternatively they can do as hatwoman's old employer did, just add the bank holiday entitlement you get on to your annual leave, and specifying that any bank holidays you take must come out of that.

Have you actually got any reason to think your employer are planning to deny you your entitlement? You don't actually say.
