handing in notice and holidays

hi, i am currently on two weeks holiday from today, and due to go back to work on the 23rd august, however, yesterday afternoon, by sheer chance i was offered the chance of full time employment, i currently work part time. My new employer wants me to start tomorrow, however i have explained to him that we are going on holiday friday so wouldnt be able to start tomorrow.

The question is, if i go to my place of work tomorrow and hand my notice in, does my weeks notice start from tomorrow, or would i have to go back on the 23rd august and work a weeks notice.

tomorrow I think but you also need to look at the pro rata amount of holiday you are entitled to compared to what you have taken so far.

I expect it will depend on what is written in your contract of employment / written statement. That document should outline procedure for termination.

Probably best to have a chat with your employer in the morning. Some employers don't want their employee to work during notice periods, so you may find they are happy with you not working the week after your holiday.

thanks for your advice, lizs , i have already thought about the holiday thing i think i will loose a weeks wage, but theres nothing i can do about that, so it looks as if septembers going to be a struggle!!

nannynick, i have read my hand book, and the way i have read it is, if i been employed for a month, its one weeks notice, between one month and 5 years its one weeks notice, but i cant find anything about holidays and notice.

At present i do beleive my present employer need to loose another 300 hours a month, so they will probably not want me to work my notice, but if i hand my notice in tomorrow, then they take that as my weeks notice, then obviously i wont get paid for my second weeks holiday if i am entitled to it.

Can you not hsnd your notice in while you are on holiday? Or hand your notice in in advance iyswim. If you have already clocked up the holiday they should pay you anyway. However is the holiday year has only just started you may owe them

If upon handing in your notice you are still entitled to some holiday, then that can be paid.

As fruitstick says, you may owe them days if you have taken paid holiday which has not already accrued.

Are you working for a large organisation? If so have a chat with the HR department, they will be able to advise you.

yes im working for a large organisation, our holiday year runs from january to january, we get 6.8 weeks hols a year, as they use the bank holidays as a week too, i have already had three weeks off this year, one in feb, one in june, one in july and two now as we speak. I had a week due in december and 5 days over new year.

If it transpires i owe them holidays, how would i pay that back, would it come out of this weeks pay, or would i have to pay them back in september, or would i have to work the 23/8/09 for a week.

It would usually be deducted from your final pay packet - so from August's pay if they are paying monthly.
