My son in law has just phoned.

He is currently a assistant general manager or a bar/restaurant which has just been taken over.
He works 70 hours a week for 19k.

They have had him in the office and told him his work is not up to scratch, therefor he is now TRAINING to be an assistant general manager and his wage is now 14k.

If he doesnt accept, they will give him a disciplinary and sack him.

Surely this isn't allowed?

He cannot afford a drop in 5k wages.

Please can anyone offer advice?

if they were to reduce his salary at this stage, it would be constructive dismissal (ie: he could resign and claim unfair dismissal, assuming he has more than 12 months service)

If they follow a fair performance enhancement procedure (a series of action plans followed by disciplinary hearings and warnings), then a sanction short of dismissal could be demotion, but they ought to be giving him the remedial training now as part of the performance improvement.

if he has less than 12 months service, then there's not a lot he can do.

if he is really working 70 hours/week for £19K he's probably not earning minimum wage, so that's unlawful and there are laws about breaks, rest periods etc under the working time regulations.

Thank you so much for your reply.
He has negotiated 16k, but they are newly married and will struggle, but he understands that a 3k reduction in wage is better than nothing!
He hasan interview on July 1st and is still actively seeking other jobs.
Ive said that everything happens for a reason so just carry on for now, even though 70 hours is far too much to work a week.
