How quickly should you get a new contract when you start work?

I've chased 4 times. I have no contract, no crb check- haven't even been sent a form(compulsory as working in a college), they have not requested my bank details yet so obviously they can't pay me.

Started beginning of January.

Haven't you been paid at all since January then?

LauriefairycakeeatsCupid · 19/03/2009 20:43

No, they haven't sent me anything yet including the bank details form.

That's terrible. Have you got the name of anyone from personnel?

cornsilk · 19/03/2009 20:44

Are you in a union?

flowerybeanbag · 19/03/2009 20:45

You are entitled to a contract or a written statement of the main terms and conditions of your employment within 2 months of starting work, so they are probably breaking the law as well as being astoundingly inefficient. What excuse do they give you when you chase? Has your manager chased on your behalf?

Lilymaid · 19/03/2009 20:47

Sounds like administrative incompetence. I would speak to your manager and or the wages people to see whether they have forgotten you.
In the past, you weren't entitled to a contract of employment until you had worked 13 weeks, but I'm not sure whether that is still the case. Of course, you do have to be paid with or without a contract.

MrsHappy · 19/03/2009 20:47

You're entitled to be given a written statement of your particulars of employment within 2 months of starting employment. They are in breach of their statutory obligations - although in not paying you they are behaving badly anyway.

I would be inclined to submit a written grievance to whoever is in charge of the whole shebang. That will hopefully get something moving.

LauriefairycakeeatsCupid · 19/03/2009 20:48

Not in a union. I don't even know if there's a personnel department or where it's locates (multi-site). The person I've been going through who hired me (I've only met her once) is one sentence emails 'yes, I will sort this out'.

I'm tempted to email again and say that I will go in and pick up the pack to save her posting it. The site she is on is an hour away so I've put off suggesting it.

I don't have a manager (I run weekly coaching sessions on my own)

There must be someone with overall responsibility. Who monitors your work, who will appraise you, who will give you feedback? Who is in charge of where you work? Anybody senior!

callmeovercautious · 19/03/2009 20:59

I am confused - you have been working one day a week since beginning of January and you have no contract and no pay yet?

Go in/or call and ask for HR at reception. You should have had an induction that covered all of this.

Do not do any more work unless you get some pay and a contract.

You must report to someone? Be contracted by someone? Who was your offer letter from?

Or do they think of you as a contractor? Perhaps they are waiting for you to invoice them?

callmeovercautious · 19/03/2009 20:59

Snap Flowery

LauriefairycakeeatsCupid · 19/03/2009 21:00

No-one will do any of those things Flowery. The woman who interviewed me is the only person I met and it's her I have been emailing.

One of those enormous projector screens about 5 feet above me (not used by me) fell on me when I was tidying up - I mentioned it to the caretaker on my way out the building and he just shrugged and said it's always doing that. My bloody head bled all the way home (why do heads bleed so much )

Maybe I'll email her again - is 4 times not enough ffs - it's been two weeks since I last emailed - I don't want to pester though but equally I don't really want to do this for free.

I am not a contractor (I will be paye). I have no contract, no offer letter, they needed someone at short notice so I started that day.

You are not accountable to anyone at all??

callmeovercautious · 19/03/2009 22:12

You need to contact the management at the site. As I said call HR dept tomorrow first thing. I suspect they will not know who you are. If that is the case then ask to speak to the head of the dept you are working for.

Then explain everything.

Do you have an email with any details on?

LauriefairycakeeatsCupid · 19/03/2009 23:07

The HR dept definitely will not know who I am as the head of dept (the woman who interviewed me and who's email I have) is the one who is supposed to have sorted this.

She is also who I am loosely accountable too - she mentioned meeting up with me in a few months to see how it's going.

I have nothing with details on, just an email saying she would be sending out the necessary forms.

Laurie - I fear you are on a loser here. You must call HR at the College tomorrow and sort this out.

Take a copy of the email from the "woman" and go speak to them.

Will be about if you need further advice.

LauriefairycakeeatsCupid · 19/03/2009 23:12

Thanks, it is all a bit strange

OP posts:
callmeovercautious · 19/03/2009 23:20

Laurie - I have worked as a tutor for HE colleges freelance and with one it was a nightmare. I suspect you have fallen into the same trap.

For me it was a head of Distance Learning who sent confirmations etc by email. After starting the work I realised they had not confirmed my contract, I chased it with HR and they knew nothing about me. I am still down financially because of that person.

You would think that being an "HR person" would have made me stop and think but it was all so quick and easy. I was working with other places and had no problems with them so stupidly assumed it would be the same deal.

I really do sympathise.
