Notice Period ?????

Help Please.
I am coming to the end of my maternity leave and don't want to return to my current job as the hours are not suitable any more. My contract notice period is 3 months but on the company maternity policy it states that " a notice period which is less than mystatutory notice period must be given". This doesn't make sense. Can i give them just a week? Help?

The policy is poorly drafted, they have missed out the word 'no' in front of 'less'. You are normally required to give your normal notice period, but it seems as though they are saying if your statutory notice period is less than your contractual notice period, you can give statutory only, which is a week when given by the employee rather than the employer.

I think this was probably a mistake as well, I think they were thinking that the statutory notice periods for employers, increasing by a week each year, also apply to employees, so they are anticipating a week for each year of service.

I would write to your manager immediately, saying that you are resigning your post and will not be returning after maternity leave. Apologise for the short notice if you are due back soon. There's not a lot they can do about it if they want you to come back for a week or two, but actually they probably won't want you to anyway. It's easier and cleaner for them having you just not come back rather than coming back for a couple of weeks while working notice.

If they do want you back, you can point out the technicalities of the policy.
