Please Help -- Redundancy pay whilst on maternity leave

Hi all,

Really need some advice if possible. The company I work for are closing and so I am to be made redundant, there are no suitable alternatives as there will be no company soon! I am currently on maternity leave but my colleagues have been told that their contracts will be honoured and they will be paid the full 13 weeks notice plus any redundancy pay plus any holiday accrued.

I was originally told that I would receive statutory redundancy pay, plus the rest of my Statutory maternity pay, plus my notice pay ( however it was made clear that the notice would be paid at maternity rate rather then my actual wage ). I have now been informed by my rep (we are in consultation until 16th of Feb) that the firm has said that the notice will be included in the statutory maternity pay, ie I will receive a lump sum to cover the rest of my maternity leave (around 25 weeks) rather than the rest of my maternity leave plus the notice.

Can my employers do this? It hardly seems fair that all they have to pay out for me is my redundancy pay ( I have just turned 24 and have worked there for 2 and a half years so this won't be much!) as the government will be paying the statutory maternity pay back to them, whilst the rest of my colleagues get paid their full notice at their full wage.

Any advice would be greatly appreciated

Notice pay should be paid at your normal rate and not SMP rate.

Hi again, hope this helps. SMP will be deducted from Notice Pay, but it must be paid at your normal rate of pay.
