Redundancy question.

My OH has just been told that his role and that of his immediate boss have been made redundant effective in 3 months time. However, they have created 2 more roles one slightly senior and better paid than his current role and one slightly junior and less well paid than his current role.

both he and his boss have been told they can apply for the jobs. If his boss got the more senior position it would mean a £10,000 pay cut. he has decided to take the redundancy and go.

My OH wants to apply for the senior position.

Is what they have done legal though? Can they make a post redundant and then employ the person they made redundant to do another similar but 'different' job.
