Termtime and obligatory closure dates

I work part-time "termtime hours" which is loosely defined as 39 weeks based approximately around LEA dates. Am just totalling up the weeks taken ready to plan ahead for this term once I return later this week. The office had an official closure from 25th December - 2nd January which is normally taken over and above AL for full time employees. Am I right in assuming that because I would n't have worked that period anyway I can't similarly claim the time off over and above my 13 weeks allowance?

if full time employees don't have this taken out of their al allowance then part-time employees shouldn't either AFAIK

Interesting - I had accepted that I would n't benefit but on reflection am not so sure I should n't query it.

You can't suffer a detriment because you are part time, so if full time employees get a couple of extra days over Christmas, that ought to be accounted for when it comes to calculating part time employees' annual leave entitlement.

Not sure what you mean by 13 weeks allowance, but your holiday should be pro rata what a full time employee gets, and just because some of the days they get are at Christmas doesn't alter the number they get iyswim. You need to base your entitlement on the total time off a full time person gets.

It is 13 weeks because I do 0.5 hours but only over 39 weeks "termtime" - which works out , taking account of the standard al calculation as 20 hours per week for those 39 weeks. I'll email and ask if I can claim those extra days prorata.

Quick update : I've had it confirmed that I do not need to deduct the compulsory closure days from my 13 weeks, so worth asking the question
