Working Mondays and bank holidays

Hi everyone, am going back to work in Feb doing 3 days a week. Mon - Weds.

I was previously full time.

My revised contract says that if a working day falls on a public holiday (my Mondays really) then it will be deducted from my leave.

Surely only a proportion should be deducted?

Do I not get half the day as a part time person with the rest of the hours deducted as leave?

If this is the case, then its a bit naughty???

I work for the public sector so should imagine its nothing different to the norm?

Depends. Do your full time colleagues get bank holidays in addition to their annual leave entitlement or as part of it?

If they get them in addition, then you should have a proportion of them in addition as well. There are 8 bank holidays a year assuming you are in England. If you work 3 days a week you will be entitled to 3/5 of them. 8/5x3=4.8, so round up to 5. You are entitled to 5 bank holidays a year.

Look at the calendar and see how many bank holidays fall naturally on your working days - the number will vary depending on when Christmas is - then if more than 5 will be on your working days, then any excess will need to be taken out of your holiday.

If they think you're getting proportionately more leave than a fulltime worker then it would be fairer to deduct a proportion of it, not all. If you work say 24 hours instead of 38 hours fulltime, then you should be entitled to 24/38 of a Monday holiday, so they would deduct 14/38 from your leave to cover the "extra" you are getting.

Their policy on leave for fulltime and parttime staff (whatever their work pattern) should be fair - you should have the same leave entitlement as someone who worked the same hours as you over 5 days, and your leave should be proportionate to the number of hours you work.

HTH - I'm also in the public sector and when I was parttime I got a proportionate number of hours for leave and for public holidays.

Thanks all. I am going from 37 hours to 22.5 hours.

I have emailed them for clarification.

I hadn't even thought about bank holidays! Do nurseries close on bank holidays?

pamelat - this was the reason I returned wed-fri!! I too worked in public sector but got given 1/2 the monday as I worked 18 1/2 hours instead of the 37 I had been.

I was warned by my boss that if I worked Mon-Wed then I would owe them 1/2 day for every bank hol which I didn't want to come out of my holidays and I couldn't make the hours up as ds1 was in nursery for the 2 1/2 days I worked.

Some nurseries close on bank hols you will have to check with the one you are going to use.
