Question re redundancy payments

A friend of mine is currently on long term sick (no longer receiving statutory sick pay) but has heard there are redundancies at work.

She was asking me whether she would get any redundancy pay if they made her redundant. I know it is normally calculated on you current weekly pay, but what if you don't get paid? Do you get nothing? Or do they base it on what you were earning before?

The 'weekly pay' used for redundancy purposes isn't like SMP - instead is it a week's pay as defined by the salary you are entitled to as per your contract.

If it was someone whose weekly salary changed all the time, you'd then use an average over the 12 weeks before the calculation date.

But if your friend has a regular salary in her contract and the only reason she is not receiving it is sickness, then should she be made redundant, she should get redundancy pay based on that amount.

It's a weekly salary which varies based on actual hours worked but in principle yes, it is a contracted salary.

That's really useful, thanks for your help. Looks like they can't use it as a cheap way of getting rid of her, which is good news from her perspective.

Maximum for weekly pay is £330 at the moment, so if your friend earns more than this that's all she'll get per week of service.

DS is fine, bit of a cold at the moment, but otherwise fantastic. He's chatting away to Tigger in bed as I type He's full of personality at the moment, just hilarious, and very very cuddly as well, which is lovely. Keeps just coming up to me and giving me a cuddle then toddling off again.

How's the little kipper?

DS uses me more for climbing on than cuddles! He's growing like mad at the moment too, I bought him some shoes about a month ago (size 7!) and I've realised this morning I'm going to go and get him some new ones. He's eating us out of house and home and sleeping 12 hours a night. It's great! He's at nursery 4 days per week now and really loves it, it's really helping his language come along too.
