please help - work saying that they have not rec'd my matbi and leave in 4 weeks!

right i have been off sick for about 6 weeks at the momenti am 28 weeks pregnant, i handed my matb1 form in on 15th may.i know that i will not be entitled to smp so need to claim ma and to do this hr need to send my matb1 form back to me with another form - right?well i ahd not heard anything backny june and was a bit concerned so went into school (where i work) and asked if she had sent it she says yes and gives me hr's number to callspoke to a lady in hr the same day and she says that the matb1 has not been sent in and she will find out what's going on and to call back the next weekso did so when i called back she said that they now had my matb1 but they couldn;t start processing it beacuase the lady in the office at work hadn;t filled in another form to go with it as she;s did not know if i was returning to worl or not (i did not think that this concerned them when processing maternity leave etc) but i informed the woman that i would be returning to work after having my baby and she said that she would inform the school and get the other lady to send the other form ini went back to the docs to get another sick note as my back is just too bad to work now and handed it in on the same dayit was a note for 2 weeks - she says you need to take it back to your docs as he hasn't put an end date on it and you cannot take your holidays and then go on maternity leave if your sick note has no end date as you will be just cased as being on long term sick i said well surely you would not be paying me sick pay if i had no note and i have not had to be signed off before coming back as obviousley the sick note is for two weeks from the date it was written!!but i took it back to the docs and got him to put an end date on and handed it in next weeknow then i was wondering if this was why by matb1 had not been processed i has been another week and i still have no form and after this week i will be taking my 4 weeks hols and then leaving on mat leave so am getting quite concerned that i have not been able to get my maternity pay sorted outi called hr today and someone different said that they had no record of even receiving my matb1 form!! i said that i had spoken to someone before and explained the abve and she said that i would have to call later in the week when the lady that i had spoken to would be in again now i am really worried and not sure what to do - the lady i spoke to today said to contact the school again about it but they are adamant that the form has been sent in help

This happened to me, I handed my MATB1 form in and presumed my manager had dealt with it correctly. About four weeks before I was due to give birth it turns out he hadn't even sent it off.
Luckily they sorted it all out without too much hassle, I hope your its resolved as qyickly.

Flowerbeanbag is the person on MN you need to get hold of I think

aww poor you mustsleep. It sounds like the original person you spoke to is the one dealing with this. When will she be back in the office? Do you think you can wait till then?

she's back on wednesday- i will have to wait till then as the other lady doesn't know anything about it

but what if they have lost my matb1 i made a copy of it as i know that they are useless but will they accept a copy?

just feel sick to death of them all though i seem to have spent this full pregnancy completely stressed about work as the school office have no idea about your employee rights etc - never even got a risk assessment

Mustsleep, if your sick note is dated, and it states 2 weeks, then all she needs to do is some simple maths. " 2 weeks" is your end date!

i know that's what i thought

just common sense really!! but they are stupid

i have sorted the sicknote anyway but still haven;t heard anything about my matb1, would have thought that they would be a bit more organised

try not to worry - you have 4 weeks to go, plenty of time.
Could you phone your midwife and ask if it would be possible to get a copy of the matB1 in the eventuality that it has been lost?

i have looked into this and someone toldme that they would only give you one matb1 form but i may be and hope that i am wrong

Whether or not you are currently planning to return to work is none of their business and completely irrelevant to any of this for a start.

It just sounds like they are a bit rubbish and very disorganised. You have been told by at least one person that they had received your MATB1, and you will be speaking to that person again later this week, is that right? You just need to be firm with them, and say you have very little time left before your leave starts, and you need to put your claim in for Maternity Allowance immediately. You have done all you need to do, they have your MATB1, all they have to do now is complete a (very straightforward and easy) form, can they please do so as a matter of urgency.

I believe you are right that midwives are not supposed to issue replacement MATB1 forms, and you can see why, they are powerful documents enabling you to claim all sorts. So you need to get a bit stroppy with HR, they've said they've got it so they need to get on with it.

Mustsleep - I've not been in your situation but I handed in my matb1 when i was pg to my employer then later found out (about 4 weeks before I was due) that I was entitled to smp from my dh as well as he also employs me to do his paperwork!

So I rang my gp and arranged to pick up a 2nd matb1 no problems. Didn't even need to see the gp.

So think getting a replacement is fine

i have not requested an application for maternity allowance yet but i thought you just got the form from the job centre or that you could download it?

will ring on wednesday and if there is stillnojoy i will have to make a midwifes appt and see if i can get another form and i will send it off myself recorded delivery

Mustsleep, just to say that when I applied for Maternity Allowance, there was quite a backlog, and I didn't actually get any money until my baby was born because of it. You can download the form, but I would do so quickly, fill it in , and have it ready to send straight away as soon as your work get their act together. I worked for the NHS, and it took about 8 weeks for them to get my SMP1 back to me.

arrgghh don;t say that i really can;t afford to have to have itback paid!!this is exactly why i want it sorted asap as i could have had it all sent off weeks ago and sorted out and not be constantly worried about it am calling them tomorrow anyway and will speak to the orginal lady who was dealing with it and say as flowerybeanbag says they need to do it urgently so that i can put my claim in

if they have not got it i will have to seeaboutgetting another form

could i just apply for maternity allowance with out sending the form to education leeds and just send it with my filled in form? i really do not want to risk them losing it again

have filled in the form and it is ready to print off but i can;t send it until i get my matb1 back and the SMP1 form from work

according to the guide notes on the form i should have started to get on with this about 4 weeks ago but have just been messed around

i will be kicking off on the phone tomorrow trust me if they have not had this sorted out

also does anyone know i have been off sick for a while now will this affect my claim as you have to fill something in on the form about this

i have called this morning and the lady said that she had sent it to payroll and if i was not entitled to smp that the system would automoatically generate the form taht they need to send back then it would get sent back to her for her to do the accompanying letter

she then went on to say that it wouldn;t have been done yet as they can onlydo them so far in the future and as they haventgot me down to start my leave until 18th august they might not be able to put it through the system until the end of July!! is this right?

i am really worried now and could just cry. she said she would call me back this afternoon after she had spoken to payroll

well one thing's for sure i will getting another sick note and not starting my leve earlier seeing as though they don;t care why should i?

mustsleep it does sound plausible that there is a system in place to generate the form and send it back, that does sound right.

What doesn't sound right is it taking so long, you need to get the form in so you get your MA. Is the lady trying to chase payroll to hurry up with it for you? See what she says when she calls you back. The person in payroll ought to be aware that you need it in plenty of time to claim your MA, so hopefully will understand and will process it quicker for you - the HR lady may not understand that.

See what she says when she calls back. If it's not helpful I'd advise calling payroll directly, as I think half the problem is communications take so long when they are going through lots of people.

thanks flowery she has just called me back and been slightly less patronising which helps when i am getting more and more frustrated

she said that payroll could not put my details onto the system as they are having a pay grading change and the system is available to look at but change anything on and they are hoping it will be back up by tomorrow so shoud hopefully get my stuff processed by the end of the week

she said that she would put a note in her diary to check next wednesday when she is in and if she hasn;t had anything through to chase it up again

which is slightly better and if she hadn;t gone on about the end of July earlier probably wouldn;t have been so upset

so hopefully things should get sorted - i hope

i filled out my ma claim form on the online form and just has one question about it if you don't mind

i work for the school but it's leeds city council that pay me so whose address do i put on my form?

I'm glad she's being a bit more helpful, sounds better.

MA claim form, don't know really - who do you count as your employer? Who is listed as your employer on your contract? I'd put whoever that is.

I work in a school, but always put the LEA/County council address on forms, because they pay me.
