leaving job after maternity leave

does anybody know if i decide at the end of my maternity leave not to return to work will i have any liability to pay any maternity pay back?

What is your maternity package - are you paid statuary pay only, or extra on top i.e full salary/half salary? You don't have to pay any of the statuary pay back (around £100 a week for nine months I think), however you'll need to check about any pay you get over and above that as you may well need to pay it back if you don't return for a certain amount of time. I didn't return to my job after maternity leave - I was obliged to return for a month but I saved up enough holiday to cover my 'notice period' - just got away with it though, they have since changed the notice period to three months so I would have had to have gone back to work out my notice or pay my extra pay back!

Only if they paid over and above SMP and stated in writing at the outset of ML that it was conditional upon your return

We have to go back for six whole months or pay the whole lot back. However, if its part time, the six months still applies, we don't have to go on for a year if its half time or something.
