Handing notice in - using unused holiday

Hi there,

I want to hand my notice in, I am trying to work out how much holiday I can deduct off notice period. I have 10 days owing.

is it pro-rated? Holiday runs from December to December.

yes, so you've worked 10 months out of 12 if you finish end October so you'd get 10/12th of your holiday allowance for this year

They will prorata whole year to give holiday allowance to last day. Take off what you have had and balance left will be what you can take/get paid for.

Yes it will be prorated. But you cannot assume you can deduct it off your leaving date, they don’t have to approve it.

In our contract it specifically stated we could not take holiday within a notice period. (although they have been know to waiver that if the person was rubbish!)

I personally would book those holidays in before resigning if you really want to use them. If you’re just concerned about being paid for them then don’t worry, they will pay what you have accrued. I just know some enployers will make you work all of the notice period and not use holidays during this time so best to book first.

Once you have handed your notice in, your employers are under no obligation to agree to you shortening your notice period by using unused holiday. They may choose to hold you to your entire notice period, particularly if they need to recruit a replacement, and pay you the unused holiday instead.

I guess you could calculate your holiday left, book the leave, once it is approved, then hand in your notice 😉
