Holiday Entitlement after maternity leave

Please could someone help me to work out how much holiday I should have?

I started maternity leave on October 18th 2021 and I returned September 5th 2022.

Holidays run January - December. 25 days a year + bank holidays.

I worked full time until I returned and now I work 3 days a week.

Am I right in thinking I should have accrued my full time entitlement up until September 5th, plus the 9 BH?

Then I accrue 3/5 of the full time entitlement for the last three months?

I work it out to be 31 days, give or take.

But, my head is a mess so I'm probably wrong!

Hi, I’m in the same boat but will depend on your contract and what your employer does, unfortunately it’s not as simple as saying 9 BH and then take 9 back as full days, as I’ve found out.

My employers have worked out my BH accrual on my new part time hours for this year so my weekly hours divided by FT hours and then divided by the months left of the holiday year, so imo penalised by this however there’s no legality around it apparently.
for the months your contracted FT so April - new hours (if it’s an Apr-Mat holiday year) its been worked out full allowance divided by x number of months (minus BH)

if anybody has any other way of how employers should work out BH, please share!

I make it 22 plus 8 bh (if they prorate those rather than allocate according to working days)

I've been given 21.46 days it seems.

That's not right, is it?

A bit late but it should be 21.66 plus 8days bh for this year. You would still have any annual leave you didn't take pre maternity leave

Thank you, @Wiaa

It's been confirmed that the system is wrong and I'm missing 8 days.

I hope they offer to pay me for some days as I'm definitely not going to use them all!

You should also get the extra bank holidays we’ve had.

They've also given everyone a "free" day as of 2022 which hasn't been added but I don't want to push my luck 🤣

You’re entitled to the extra day and will be glad of it when you’re back at work!
