Not paid

Hi just looking for a bit of help if anybody can?

Finally took the plunge and left my shitty workplace, notice period has been worked and I was due my pay yesterday.

Went on my bank yesterday to check, nothing... messaged old boss straight away to see if they could make sure it went in. Had no reply yet it has been read. I tried calling, no answer.

Tried again today, still no answer, still no pay...

I haven't got access to the payroll as it was a small company and things were done through the owner.

Where do I stand here? I'm expecting a full month's wage and I have bills to pay.

Any advice is greatly appreciated.
TIA

Did you owe holiday or anything? One of my jobs was they paid your last wage via cheque . Could you go in a speak to them ?

CN12 · 16/09/2022 19:42

@Itsnevertheend
No didn't owe holidays or anything like that.
I live 45 minutes from the company so can't really just pop over. But I think if I've not been paid by next Tuesday I will go over to see.

Did you have any company equipment or anything?

Morechocmorechoc · 16/09/2022 20:00

Have you emailed. If not I woukd send one stating the facts and that you have called and if you are not paid by the end of Tuesday you will take the legal route

CN12 · 16/09/2022 21:20

@missbipolar no nothing.
@Morechocmorechoc ye dropped email, text, tried to call but no answer so left a voicemail.

I was very polite in asking and kept it professional. It was a little sour when I handed in my notice and they were quite horrible (even more so than they had been before). So I'm not really surprised this has happened.

Unfortunately I have been in this situation. Small business m/awful employer, just chose to not pay me when I left. Ended up going to small claims court for outstay pay which I won but without that owner would have done anything to not pay me.

@CN12 there are two option, the first is they have waited until you left so they can accurately calculate your final salary plus leave etc. and will pay on the next pay run. This is normally a week after your pay day.

The second is they are not going to pay and, as @Noideamuma explained, you may need to go to small claims court.

If you don’t get paid on Tuesday and there is no comms, send a letter before action by email and recorded delivery. Get a read receipt and evidence they received it. If no response, then go to small claims court. Don’t delay as you want this sorted asap.

OP, have you checked your personal tax record online to see if anything has been recorded via HMRC?
www.gov.uk/personal-tax-account/prove-identity

I remember the horrid feeling of working for small businesses and never knowing when pay was going to land.

I remember querying once if an employer could change payday once you left (not via MN) and the answer I got back was yes. HMRC allow so many weeks for a P45 to be raised if I recall. You can also on the hmrc personal tax account click: 'view or update employment details' and it will show you a date the employer has to tell HRMC you've left / produce a P45 by.

Hope you get it resolved.
