Holidays after mat leave

I've just returned to work after maternity leave and the company says I have 23 days of holiday left in this financial year. Statutory holiday is 28 days and my annual allowance has gone down because I'm now doing a 4 day week. However shouldn't I have accrued holiday during mat leave? I used the previous year's holidays up before starting it but I think I should be due some from this financial year.

I accrued FT AL after my last mat leave. Since changed company and the mat policy states it is adjusted if you return PT. Hopefully your T&Cs will be somewhere.

When I returned from DC1 I went from full time to part time. HR calculated my entitlement for annual leave during mat leave as full time and then my entitlement on returning until end of financial year as part time. They then added the 2 together and that was my entitlement to take before 1st April.

You should have accrued at previous rate during ml then 80% for balance of the year.

What dates does your financial year run? What date did you officially drop to 4days?

So 5 months at 28 days is 11.7 and 7 months at 0.8 is 13.1, total rounded up to 25.

It's nothing to do with when your employer's financial year runs.

It depends on when your employer's holiday year runs from and to, and on what date your employment changed from full time to part time.

If your maternity leave spanned two holiday years, and you used all your entitlement to holiday in the last holiday year, you should have continued to accrue holiday during the current holiday year while you were on maternity leave.

The holiday year and financial year are the same. I will have been on maternity leave for five months of this holiday year on a full time contract, returning to work on 4 days of week for seven months of the holiday year.

I was going to do a similar calculation as @LIZS - you accrue on a full time basis for the 5 months you were on maternity leave, but then when you reduce your hours, your annual leave entitlement for the remaining 7 months is adjusted. So I wouldn't expect you to return with a full time 28 days for the rest of the year, but a pro-rata'd amount taking your reduced hours from when you returned.

Just in the same way if you worked full time for the first 6 months of an annual leave year, then reduced hours for the 2nd 6 months, you wouldn't have 28 days because your accrued leave would be adjusted to your reduced hours for the 2nd half of the year and this would be reflected in your entitlement.

It sounds about right to me - as PP said, does it include bank holidays? If so you'd probably need to take off any of these you missed on mat leave depending on your work policy
