Flexible worker holiday

What would be the scenario here?
An agency worker who often works 2 days a week but other times when they only work 1 or not at all. Are they still entitled to holiday ?

I think their working hours would need to be averaged over the past 12 months and holiday entitlement calculated on the basis of that average.

No, in that case their total working hours would be averaged over the number of weeks they’ve been employed.

Thank you. Hopefully I will be entitled to some holiday at Christmas.
Been doing some work almost every week for a temp agency but some weeks (Like 3 or 4) I have not worked for them so was just wondering whether I would be entitled to any holiday.

You will accrue holiday from the start I can't remember what basic holiday is but say it's 20 days every month you will get 1.6 days of holiday.

Sorry posted too soon. That's based on working 37 hours per work. Part time will be a pro rata equivalent.

Most agencies deduct from your pay each week for holiday pay so you can take as much as you've banked at any given time. If you leave the agency they pay you anything left in the pot with your last pay. Works well unless you are working in a company who operate shut downs which may fall before you've accrued enough paid leave to cover the entire shutdown period in which case it would then be unpaid leave (HR manager here)

No pay is deducted from my income each week.
I was just wondering as I do very little with the agency yet it says I am still entitled to holiday pay.

Check that your holiday pay is not included on your hourly rate.
