hello all,
Hope someone can shed some light on this pls

So on long term sick pay (SSP is 28 weeks)

At around the 25th week, the contract my team was working on at company A got taken over by company B & we were transferred to the new company

I was told by company A that my sick pay will restart again from week 1 once I get to company B (I was surprised but felt they know more about HR issues than I do)

In company B now & they are saying sick pay won't restart from week 1 but will continue from where it was in company A.

Also company did allow printing from there system which meant I couldn't print my contract but had access to it on my account. Although I email HR many times to get a copy but never got a reply.

Now I was told contract from company A will remain same with company B & would be notified of any changes but haven't got ant notification yet.

Due to start work again because 28 weeks is up even though I am still not well but have no choice. I have asked them for my contract & company B are saying company A haven't sent the paperwork for the transferred employees to them since April the 1st. Which means I'm going to start work without a contract. I Dont even know my pay rate 🙄🤦🏽‍♀️.

Is it correct that sick pay (SSP ) should restart at company B? I ask because I am really not well enough to go back to work yet.

Have you be tuped across?

This might help you but no ssp doesn't start again I'm afraid www.gov.uk/guidance/statutory-sick-pay-business-changes-that-affect-payment.

Have you been TUPE'd? I wouldn't imagine it would start again though.

Mammyloveswine · 10/05/2022 12:42

I'm sorry you are unwell but I would be very surprised if it was to re-start!

Can you have reasonable adjustments made?

Crazylazydayz · 10/05/2022 19:01

SSP is continuous.

WRT your original contract, make a joint SAR to both companies Data Protection Officers and request a hard copy of your original contract.

SSP will not start again. If you are still not well enough to work and have paid NI contributions for the past 2-3 years then that could be claimed once SSP ends although would start at a lower rate than SSP.

It won't restart no but you'll be eligible for sick pay from the government it'll just be peanuts.
