Sick Leave Entitlement

Can anyone advise when your contractual sick leave entitlement "restarts"? I recently returned to work after a long term absence where I was fortunate to receive full pay followed by half pay for the remainder of absence.
After accrued annual leave had been given etc I returned to work after what became a years absence.

I'm not intending on going off unwell (don't think anyone every does!) but have just realised that if I did I may have exhausted my contracted sick pay entitlement...

Does anyone know when this would "restart" to my previous entitlement? Don't want to ask work as they may feel I'm taking the p*or intending to go off sick again which I'm not!!

Hey, hope you are feeling better! It would start 1st January, company sick pay is calculated on an annual basis.

It depends on the wording. It may be a rolling 12 month period for example or a fixed timeframe.

Most employers use rolling 12 months, it will be in your contract or employee handbook or sickness policy.

As it is contractual, it is down to the individual company policy.

You start counting 12 months on from the first date of one sick leave before your leave resets. So you only get paid osp for x weeks in one 12 month period.

15 years as an employment lawyer and I’ve never seen a contract say this. Where does 1 January come from?

Anyway - as PPs have said, it’s usually a rolling 12 month entitlement. But nobody here can give you the answer - you’d have to check your contract of employment and relevant sickness policies.

An employee absent from duty due to sickness or injury will receive, in any one period of 12 months, sickness allowance as set out in table

@LIZS So if I went off say in November 2020 and was back on payroll end of September 2021 (meaning I'd exhausted all full and half pay available to me) would I be entitled to any paid sickness leave if I went off now?
For example would they look at my sickness between March 2021 and March 2022 and calculate I was off for 7 months during that period so therefore count a new absence onto those 7 months?

This is really muddling my head, think it's the fact I was off for almost a year making me think I perhaps have to work a full year before entitled to anything again?!

Hi OP. I used to do the payroll for a massive company and spent a lot of time working out sick pay. Most companies use a 'rolling year'. A rolling year means that you are entitled to a certain amount of days for a year from your first day of sick leave. So if I was entitled to 10 days sick leave (just using 10 as it's an easy number) and took 10 days off starting today, I wouldn't have another day of paid leave until 10th March 2023.

If I was doing your sick pay and you were entitled to a years paid leave I would see how many days you had used in the last year, so I would look back to 10th March 2021 and count your days off sick.
