Holiday Entitlement Query

CymruCariad12 · 14/01/2022 20:03

Help please,
I have worked for my employer for quite a few years, working 5 hours a day Monday to Friday, 5 day working week.
Until recently my holiday entitlement has been based on a 4.5 working week. If I wanted to take holiday on any day Monday to Thursday it had to be booked as full days, but if I just wanted A Friday off, I was to book it as a half day, even though I actually had the full day off.
I have been informed that my holiday entitlement is wrong and that they need to increase my holidays to be based on a 5 day working week, which I am fine with, but what I am not fine with is because they are increasing my holiday I now have to take Friday as a full days holiday. Some advice would be helpful.

You have been getting a full day for a half day holidays allowance. You know need to use a full days allowance but you are getting an extra half day's allowance so theoretically you haven't lost out

But surely the increase in days will cover if? Say you get 18 days now, it equates to 4 weeks, so they'll give you 20 days going forward which is still 4 weeks?

Work it out in hours and deduct each day's leave in hours.

I think that they have been and continue to be more generous than they really need to be with you. I would not be complaining about this.

But you're taking a full working day off (as your contract states you only work 5 hours a week), so why shouldn't you have to use a whole 5hr day of holiday? Confused

I'm sorry but they are right. They should never have been doing it in the way you report. Unless you took at least 5 Fridays off each year (more if they give more than the legal minimum holiday entitlement) you were being short changed on holidays.

AlexaShutUp · 15/01/2022 10:09

I'm unable to get my head around why they had the old system in place. It makes no sense to me. Confused The new way sounds much more in line with what I would expect.

But you do work the same number of hours each day so each day should be a full days leave - and you should get the same number of days as every other worker who works 5 equal days a week.

Your employer is correct. It sounds like it is being evened up with your holiday allowance anyway.

ChateauMargaux · 15/01/2022 10:27

It depends on how it has been worked out.. you are entitled to 5.6 weeks of holiday. As you work 5 days per week.. you are entitled to 28 days a year. If they have been giving you 25 days and you have actually taken 28 because 6 of those were on a Friday then it’s OK. You have had the right number of days in total.

PrincessPaws · 15/01/2022 10:59

It was wrong in the first place and should have been based on 5 days because you work 5 days, they are correcting it now. Just be grateful they aren't asking to recoup any extra time taken previously

HunterHearstHelmsley · 16/01/2022 21:33

If they have increased your holiday allowance then you are no worse off. Why would this annoy you?

HunterHearstHelmsley · 16/01/2022 21:38

Do you mean, based on statutory minimum (excluding bank holidays), you were previously getting holidays based on 33.75 hours (c.169 hours) and now your holiday allowance is based on 25 hours so you will get around 125 hours leave?
